Scope of work and Special Terms & Conditions
1.Scope of Work: This specification provides for Design, Manufacture, Supply, Inland Transportation, Transit Insurance, Local delivery, Installation, Cabling, Testing, Commissioning and handing over, Documentation, 5 Years warranty of 449 numbers of PCs for NCR Region.
Delivery: The systems shall be delivered in full at per consignee list within six weeks from the date of the specific letter of award.
2.Payment Terms: 90% payment shall be done on successful installation and commissioning of equipments. Balance 10% payment after expiry of warranty or after submission of equivalent amount of BG duly verified by NTPC Limited valid for a period of 66 months (60 months warranty + 6 months installation & claim period).
3.Warranty: On site comprehensive five year warranty from the date of installation. All the material shall be covered under onsite maintenance for the entire period with break fix services guaranteed by OEM party in line with the requirement of this document.
4.Inspection: Inspection shall be done at site on receipt of material.
5.On Site Warranty Terms: The equipment shall be warranted for trouble free operation with availability of 97% PER YEAR (reckoned per quarter basis) for a period of FIVE years after commissioning and successful acceptance testing and handing over to the User. Warranty Certificate confirming five year onsite warranty from OEM in respect of Personal Computers shall be submitted.
It will be the responsibility of the bidder to maintain and support the system fully, to provide all supplies of spares and services including software support & patches and help to users for virus protection (owner provisioned if any) and Windows for maintaining the systems availability. In case the supplier fails to provide an overall availability of 97% during warranty period, and/or fails to provide related service, the warranty period shall be extended on a pro rata basis depending on the down time. However, the average up time of any system should not be less than 95%, if it is less, the system shall be deemed to have failed to perform. Replacement of defective parts of all types including Hard Disk Drives, Display Devices, Plastic Parts, Rechargeable batteries (on the motherboard) is in the scope of warranty. Defective parts except media shall be returned to supplier on receipt of replacement. In the event of HDD replacement supplier shall either allow the owner to retain the defective HDD or shall take out the media and hand over the same to the owner.

Response time shall not be more then 24 Hrs. and resolution shall have to be ensured within 48 Hrs. of Response time indicated. Any failure to resolve the complaint will make the supplied to provide a standby system of an equivalent or better configuration for a period till the complaint is resolved and original system restored. Faulty system shall be allowed to be taken by supplier only on provisioning of the standby system. Bidder shall stock sufficient spares, locally so that he can provide an efficient service.
6.Evaluation Criteria: Evaluation shall be done on Package basis i.e all supplies and services shall be procured from single source. BID Price shall mean the sum of all items in BID PROPOSAL SCHEDULE for complete scope of work.
7.Liquidated Damage: The timely delivery of the material is the essence of the contract. In the event of supplier failure to deliver the material of acceptable quality within the stipulated delivery period, the liquidated damages are payable by the Bidder @ 0.5% (one half of one percent) per week of delay or part thereof, of the unexecuted order value. However, the total liability of the Bidder under this clause shall not exceed 5% of the individual PO placed value.
8.Work Schedule
a)Under supply Portion
i)Supply of Material (H/W and S/W) as indicated in BOQ.
ii)Installation of the supplied Material (H/W + S/W).
b)Under Warranty and Services
i)Migration / configuration Services such as Data Transfer, Mail Box Creation, LAN setting & IP address configuration, loading the anti virus agent and ADS client etc; at the time of installation or
ii)Maintenance and break fix services during Warranty period of five years after successful installation and handing over.
9.CPG : The successful Bidder shall furnish a contract performance guarantee against this order towards successful performance of the contract for 10 % of PO value , valid for a period of 66 months (60 months warranty+ 6 months installation & claim period)
10.Availability and deductions:
These availability requirements are associated with non performance deduction so as to ensure the desired uptime availability and delivery of service to NTPC. These availability requirements shall remain effective during warranty period.

Non performance deduction during this period shall be calculated using the formulae in respective columns of the following table. Bidder will maintain the logs for each service provided and shall provide necessary reports to ascertain the service levels and calculate the non performance deduction.
The log shall be submitted on quarterly basis and the downtime deductions if any shall be arrived at on quarterly basis.
Deductible amounts if any shall be intimated to supplier on quarterly basis. During the warranty such amount as intimated shall have to be deposited at the respective location where the Personal Computers have been supplied against this PO.

NB: All these deductions as mentioned above are independent of LD liable as per the commercial conditions. Deduction during warranty are %ge of respective award value.
Repeated break down of the same system for more than 5 occasions consecutively on account of the same problem can call for a replacement of the systems.
