NAME OF WORK: -
Job Contract for unloading and disposal of 10 Lac MT of fly ash in pit of Gorbi mines of NCL in
slurry form over a period of two years.
Work involves establishing the infrastructure and installation of equipments for the purpose and
deployment of required manpower for round the clock operation, maintenance and security at the
site of abandoned Gorbi mines of NCL.
GENERAL SCOPE OF WORK:
The work mainly involves Supply and/or installation of items as per Table 1 below at Gorbi
site for round the clock working and development of process/mechanism for unloading of
fly ash from bulkers and mixing with water and disposal of ash water mix in pit of Gorbi
mines. Deployment of manpower as per Table no. 2 for Operation, Maintenance and
Security of the installed systems.

Note:
1. The installation and interconnection of all equipments shall be done as per
instruction of EIC.
2. Foundation / platforms / pedestals for each equipments & pipes shall be constructed by the
agency on their own cost.
3. Fuel for DG Set, lubricants for other moving equipments shall be provided by agency,
nothing shall be payable extra in this regards.
4. Operational overhead expenses and maintenance of equipments shall be in the scope of
agency.
5. If the unloading work is hampered by equipment breakdown that renders any one of the
three Unloading streams envisaged unavailable for more than 8 hrs, a penalty at the rate of
Rs.1000/hr will be imposed on it and the same will be deducted from his RA bill as per the
discretion of EIC. The agency is advised to keep enough spares to prevent such a situation.
6. Agency has to establish 03 unloading streams of equipments for emptying of 03 trucks
simultaneously. All 03 unloading points shall be in service round the clock.
Scope of work - Operation assistance/Maintenance/Security:

DESCRIPTION OF WORK (Operation & Maintenance)
1. The agency through its Supervisor and operational assistance staff shall be responsible for
round the clock operation, monitoring, normalization, isolation, record keeping, fly ash
unloading from closed trucks. The work mainly involves –
i. Assistance to entry of loaded and exit of unloaded truck with proper logging and record
keeping.
ii. The assistance staff shall assist the driver for parking of loaded vehicle at the site.
iii. Unloading of ash from trucks through operation of submersible pumps and fluidizing air
blowers as per the established procedure.
iv. Acknowledgment of issued gate passes to trucks drivers and to certify the gate pass.

v. Keeping a record of all the shift operations in the logbook and Reporting (at the end of
each shift) of gorbi unloading area regarding running equipments, availability of
operating and standby equipment and number of trucks unloaded.
vi. General house-keeping. Agency shall ensure the complete cleanliness of floor at
working site.
2. The agency shall provide Personal Protective Equipments to himself and the workers
deployed and also ensure that these PPEs (Like safety helmets, nose mask, safety shoe,
florescent jacket etc.) are being used.
Note:- The minimum nos. of workers mentioned above shall be deployed by
the agency. However, if required, the manpower will be enhanced by the
contractor as per instruction of EIC.
DESCRIPTION OF WORK (Security)
1. The contractor shall deploy 01 Gun man, round-the clock, for safety and security of men &
machineries deployed at Gorbi mine as per direction of EIC of the contract. Any untoward
happening in the unloading/working site premises at Gorbi mines shall be immediately
reported to the EIC/ Area engineer
2. Scope of work under this head shall also include:
a) Prevention of entry/Removal of unauthorized occupants from gorbi mine site.
b) Preventing the entry and controlling the movement of cattle, stray animals, wild
animals etc. in site area at Gorbi.
c) Assistance and protection in case of strikes, riots, labour-unrest etc.
d) Any untoward happening in the working site premises at Gorbi shall be immediately
reported to the EIC/ Area engineer/CISF/HOP.
e) Effective liaison with police and district administration and lodging of complaints/FIRs
with the concerned authorities, if and when required, with prior consent of NTPC, and
pursue the progress of the cases.
3. The Security Guards will be provided with motorcycles by the agency for prompt and effective
discharge of their duties. The agency will also provide mobile phones with SIM connections to
the security personnel and site supervisors for easy contact during emergencies. The cost
towards provision of the motorcycles and mobile phones is to be borne by the agency and
NTPC will not entertain any separate claim regarding this.

GENERAL TERMS AND CONDITIONS
1. Bidders Quotation:
Bidders have to quote rate on disposal of 01 MT of fly ash basis from loaded truck into the pit
of Gorbi mines. The disposal rate of 01 MT of fly ash shall include all the expenses towards
supply, installation, operation, maintenance of all above mentioned equipments with
deployment of minimum no. of workers mentioned in the above scope of work and it shall
also include the cost of site security. The agency shall also be responsible for the overhead
expenses and any expenditure for some additional work / material if required during the
execution of work. Total Fly Ash of 10,00,000 (10 Lacs) MT shall be dispose in Gorbi mines
pits during the entire period of contract which is 731 days.
Hence, Agency is advised to quote the rate on disposal of 01 MT fly ash basis for total
quantity of 10 Lac MT over a period of 731 days.
2. NTPC Scope of Supply at free of Cost: Nil.
3. Contractor’s Supply at their cost:
I. Deployment of sufficient manpower as defined in Scope of Work as per Table - 02.
II. Equipments & other consumable overheads mentioned in "Table - 01" of General scope of
work.
4. DURATION OF WORK: Duration of the work shall be of 02 years (731 days) from the date
of start of work or as decided by EIC NTPC. However the contract period and quantity may
be extended or reduced if required by EIC NTPC at the same terms and conditions of the
contract.
5. Miscellaneous:
A. For work of operational assistance in shift operation, round the clock deployment will be
required without any break. The agency shall have to follow the NTPC/VSTPP operations
Shift Rota timing and they have to deploy the workmen accordingly. The present shift
timings for Main Plant Operation are:
Morning Shift: 0700A.M. to 02.00 P.M.,
Evening Shift: 02.00P.M. to 10.00 P.M.
Night Shift: 10.00 P.M. to 07.00 A.M.
EIC will have the discretion to change the shift timings if the necessity arises.
B. The agency or its authorized representative should make himself available for receiving
instruction daily in morning at 8.30 AM from Engr.-in- charge or his representative in his
office and for giving work status and for submitting check lists to Engr.-in-charge.
Supervisor of morning shift shall be responsible for submitting daily shift checklist in the
next morning in soft copy and in a week in hard copy.
C. The agency or its authorized representative will be required to submit category-wise list of
personnel being deployed at site, along with the qualification documents, and shall take
prior permission for deployment of personnel. The skilled workers so employed by the
agency should have required technical knowledge and communication skill to get the job
done and should know about the scope of work of their representative areas and he is to
be aware of all the location about Gorbi & its surrounding areas.

D. The agency or its authorized representative shall be responsible for submission of
documents for record and proof with EIC such as Insurance paper, wage sheet, gate
passes copy after issue / renewal, proof of issue of PPEs to the workers, and submitting
the bill quantity on schedule date as per billing cycle (or as required by the EIC).
E. During emergencies, the Engr.- in- charge shall have discretion to get some extra work
done from the agency in area other than that specified under the scope of work. However,
the nature of work will be minor.
F. The agency shall immediately remove those worker/s from the work who in view of Engr.-
in charge are negligent in performing their duties, incompetent to perform their work,
misbehaving with transporters / drivers, indulged in extortion, consuming liquor at the
workplace or are found guilty of misconduct. Such persons shall not be deployed again
without the permission of Engr.-in charge.
G. The agency has to attend any emergency work on short notice whenever required.
H. It is the responsibility of the agency to give weekly off and other holidays as per rules to
the workers engaged by him. However, deployment of the required number of the workers
and supervisors on all days, including Sunday & other Public holidays is to be ensured by
the agency.
I. NTPC never discourages deployment of female workers at the workplace but for this work
deployment of female workers shall be prohibited because the execution site located in
remote and secluded location at Gorbi.
J. Child labour / minor shall not be deployed under any circumstances.
K. Agency shall have to execute the work on every Sunday, national holidays and gazetted
holidays also. EIC may instruct from time to time regarding the priority of work to be
performed and the agency has to follow the same.
L. The agency shall not at any time cause or permit any nuisance or do anything, which shall
cause inconvenience at site.
M. The mobile number of skilled worker & security person engaged in each shifts shall be
communicated to operation group of EIC round the clock to ensure proper
communication.
N. The agency shall abide by all the instructions of EIC or his representative which are not
mentioned above but are required for effective execution of work.
O. The agency shall issue identification card to all the workers engaged in above contract for
ease of identification.
6. Documents to be Submitted :
A) At the time of start of work:
a)
Complete list of workers, along with identification and qualification details
(As per
format)
b) WCA insurance copy
c) Copy of Labor/migrant labor license, if applicable.
d) Copy of Employment Card for all workers (with signature of individual worker that he
has received the Card )
e) Copy of Government issued identity card -PAN /Aadhar/ Voter ID/ driving
license/passport etc.
f) Copy of Qualification certificate
g) The medical fitness certificate issued from Govt hospital for all the workers.

B) Documents to be Submitted at the time of running bills:

a) Copy of Labour License, as applicable- for total period of contract,
b) Copy of WCA Policy- category wise of the workers engaged by the Agency
c) Copy of Month wise PF Challan along with month wise detail of PF contribution
d) Copy of Month wise Wage Register. Certified by EIC/Representative
e) CCP 10 & 11 (Contract closing procedure)
f) EPFS- Employer E Sewa Form no.-23 as applicable
g) Other than the above mentioned documents , if any other document is required to fulfill
statutory/NTPC management requirement, party has to provide the same.
7. Deductions:
A) Delay of Work due to non-availability of any equipment as per schedule:
If the unloading work is hampered by equipment breakdown that renders any one of the
three Unloading streams envisaged unavailable for more than 8 hrs, a penalty at the rate
of Rs.1000/hr will be imposed on it and the same will be deducted from his RA bill as per
the discretion of EIC.
B) Poor workmanship, deficient deployment of manpower and negligence
a) If manpower deployment found deficient as per scope of work then deduction of two
times of base rate for each category of absence workers shall be imposed on agency.
Moreover EIC has all the liberty to impose additional deduction of up to Rs. 1000.00
per shift if the work performance is not satisfactory in spite of repeated instruction for
each instance. Amount of deduction shall be decided by the EIC and no objection shall
be granted.
b) If any instance of misbehaving, indulged in extortion, consuming liquor at the workplace
is reported on account of agency, EIC may impose an additional deduction of up to Rs
2,000.00 per shift.
c) Special penalty of Rs.2,000/- per shift may be imposed to the contractor in case of non-
following of instructions.
C) Deduction for Safety: As per the NTPC safety guidelines.
a) The Agency and its workmen shall have to follow all safety norms / rules while working
at site as per safety clause for operation & Maintenance in NTPC Vindhyachal failing
which deduction of amount shall be done as per the safety compliance rules applicable
for the agency.

8. PAYMENT TERMS:-
i. For the purpose of calculation of rates following wage rates have been considered:
USW-Rs.390, SSW-Rs.457, SW-Rs.551.
ii. Payment shall be made for quantity of fly ash (MT) disposed in pit of Gorbi Mines on
monthly basis. The party has to submit the relevant papers as per factory act with the
running bill as mentioned in the relevant clause of documents required to be submitted
with the running bill. The payment shall only be made for the jobs executed as per the
schedule of quantity.
iii. Payment to agency’s workmen shall be made by 7
th
of every month and for this agency
should have sufficient fund if their bill have not been paid within above said time by
NTPC/VSTPP.
iv. Agency should maintain attendance register for its workmen/ supervisors. Agency
should issue attendance card to its workmen and put their attendance on it. Agency
should disburse the labour payment through bank account.
v. The agency shall have to pay at least minimum wages or higher to the workmen
engaged under latest minimum wages act of Central Govt. / MP Govt.
vi. The rate is inclusive of the overall profits, T&P, medical, safety, insurance,
consumable, hose pipes for air & water, labour license, insurance, PF etc.
vii. Agency shall ensure that bank account to all its workmen is available. Payment to the
workmen of the agency shall be made through bank.
viii. In case the department receives any written complaint from member(s) regarding
non payment of wages, the amount payable to them will be recovered from the
contractor’s bill and will be paid to them. 10% administrative overhead charges shall
also be deducted from the contractor’s bill. In case the contractor further fails to pay the
wages to labours, NTPC will make such payment to the labours at the risk and cost of
contractor and may forfeit security deposit also.
9. Deviation: Total contract value may deviate ± 20 %.
10. Record Keeping: Proper record of all the activities and the available workmen is to be
maintained as per area-in-charge or their representative.
11. Criterion for increase in Minimum wages :
A. Escalation in minimum wages with PF, if any, shall be paid as per actual wages
payable to the workers (As per M.P. Minimum or Central Minimum wages whichever is
higher) i.e. wage sheet and PF challan submitted and certified by EIC. Base rate for
calculation of escalation of labours wages shall be Rs. 390.00 for USW, Rs. 457..00 for
SSW and Rs. 551.00 for SW.
B. NTPC Vindhyachal is not liable to reimburse extra for escalation & PF due to increase
in minimum wages of workers. Agency has to comply the labor law rule, PF & minimum
wages.
12. TERMINATION OF CONTRACT:
A) The contract may be terminated by giving one month advance notice to the agency.
But, if the agency desires to terminate the contract, the agency shall have to give a

written notice three months in advance to the management. Suitable amount as per
rules of NTPC shall be forfeited from full and final bill of the agency in such cases.
B) The performance of the agency shall be reviewed by the management of NTPC every
month, and if found unsatisfactory, the contract shall be terminated at any point of time
without assigning any particular reason and the security deposit shall be liable to be
forfeited.
C) In case of dispute regarding operation work related activities the decision of Engr.-in-
charge shall be final & binding on the agency.
D) The agency shall be responsible for all risk involved, liabilities and obligations arising
out of contract under any provisions of law in force from time to time.
E) Agency shall be completely responsible for the conduct and discipline of its workers
including himself during the tenure of the contract and in case of any misconduct or
indiscipline, EIC has all the liability to terminate the contract with forfeiting the security
deposit.
13. SPECIAL TERMS AND CONDITIONS
a) Guards deployed should have sufficient experience and should be medically fit. The
agency has to submit the relevant documents regarding their past service, age,
experience along with certificate for scrutiny by NTPC before deployment of security
guards. Security guards are to be deployed only after approval of officer in charge.
b) The guards should adequately be trained in the unarmed combat and use of arms and
lathis.
c) Guards will be provided with proper uniforms. In case the contractor has not issued a
new uniform/any guard is found without uniform, cost of uniform shall be deducted at
the rate of 5 % of HSW base rate (per day).
d) All the guards will carry pen, pocket notebook and LED torch at night.
e) The contractor will arrange suitable transport for mobility of his workers and security
guard at his own expenses.
f) In case of absenteeism, suitable substitute shall be provided by the contractor without
any additional liability to NTPC.
g) The security staff will not indulge in any union activity or become member of any trade
union either our own company or any other union of the area. If any of the guards
indulge in union activity, the contractor will replace such person from his side.
h) The agency shall be responsible for all the articles like equipments / tools / water
coolers / air coolers / furniture and fixtures, hose pipes, T&P etc. at working site area
against any damage / loss etc.
i) The work shall be executed as per GCC and instructions of EIC. The agency shall
abide by all the instructions / rules / guidelines given by NTPC Management from time
to time which are not mentioned above but are required to be followed during execution
of above said work.
j) The cost of PF @ 13.00%, bonus @ 8.33%, Insurance @ 2.36%, Retrenchment
benefits @ 4.17% of minimum wages shall be kept as limits by NTPC EIC and the

same shall be released production of documentary evidence only after its actual
distribution among the workers. The amount of RB shall be released after completion of
contract.
k) The agency has to arrange for insurance and safety of contingent manpower at their
own cost. Expenditure towards safety, insurance & medical has been considered in the
rates.
l) The contactor shall indemnify the corporation against all losses and claims for injuries
or damage to any person or property whatsoever which may arise out of or in
consequence of the operation of the contract and against all claims, demand,
proceedings ,damages, cost, charge and expenses whatsoever in respect of or in
relation thereto.
m) The contractor shall follow all labor laws and other applicable laws.
n) In case of litigation, the case of action shall be deemed as arrived in Singrauli district
only and district court of Singrauli, MP, shall have the jurisdiction for all purposes.
o) The decision of EIC shall be final in matter of withdrawal/removal of any of the persons
deployed by the contractor and the contractor shall be bound to replace such
personnel.
p) The contractor shall pay forthwith any compensation payable to any of the person
deployed by them for injuries, disablement etc. while on duty as per the provision of the
Workman’s Compensation Act.
q) The operational work & security work shall be executed at all times and on all the days
of the year including, Sunday, holiday and National Holidays and no extra payment for
duties on national holidays shall be claimed by the agency from NTPC.
r) The rates shall be firm and increase in minimum wages as and when notified shall be
payable by NTPC during the currency of the contract.
