1.0 NTPC Ltd. invites sealed bids from eligible bidders for Hiring of 02 nos NON-AC travelers
for station duty at NTPC-BgTPP for Bongaigaon Thermal Power Project (750 MW)
situated at Kokrajhar district of Assam State and is approximately 15Kms from
Kokrajhar. The Project site is situated between Kokrajhar and New Bongaigaon railway
station of North Eastern Frontier Railway. Bongaigaon town is about 35 Kms away from
the Project Site, as per the Scope of Work mentioned hereinafter.
2.0 Brief Scope of work
The brief scope of work is as under:
Hiring of 02 nos NON-AC travelers for station duty at NTPC-BgTPP as per BOQ specifications,
and as per direction of Engineer-In-Charge.
3.0 Detailed specification, scope of work and terms & conditions are given in the Bidding
Documents, which are available for examination and sale at the address given below
and as per the following schedule :

Price Bid opening date & time shall be intimated to qualified bidders later by NTPC
Ltd.
4.0 All bids must be accompanied by Bid Security for an amount equivalent to Rs.
1,00,000/- (Rupees One Lakh Only) in INR.
5.0 QUALIFYING REQUIREMENT FOR BIDDERS
The bidders who wish to participate in the bidding shall satisfactorily establish that they
fulfill the following Qualifying Requirements:-
1.0 Technical Criteria
The bidder should have successfully deployed & operated any commercial vehicles
i.e. Car/SUV/Trucks/Buses/Shuttle Vehicles in any NTPC project or any other
industries meeting any one of the following criteria during last 07 (seven) years prior to
the date of techno-commercial bid opening:
At least one order of value not less than Rs. 16.95 Lakhs.
Or
Two orders, each of value not less than Rs. 10.60 Lakhs.
Or
Three orders, each of value not less than Rs. 8.48 Lakhs.
The word ‘executed’ means that the bidder should have achieved the progress
specified in the above para even if the total contract / order is not completed / closed.
The same shall be supported by documentary evidence issued by the owner.
2.0 Financial Criteria
2.1 The average annual turnover of the bidder, in the preceding three (3) financial
years as on date of techno-commercial bid opening, shall not be less than Rs.
21.19 Lakhs (Rupees Twenty One Lakhs & Nineteen Thousand only).
2.2 NOTES :
(i) Other Income shall not be considered for arriving at annual turnover.
(ii) The bidder shall submit documentary evidence/ proof of meeting qualifying
requirement stipulated above.
(iii) In case where audited results for the last financial year as on date of techno
commercial bid opening are not available, the financial results certified by a
practicing Chartered Accountant shall be considered acceptable. In case, bidder
is not able to submit the certificate from practicing Chartered Accountant certifying
its financial parameters, the audited results of three consecutive financial years
proceeding the last financial year shall be considered for evaluating the financial
parameters. Further, a certificate would be required from CEO/CFO as per format
enclosed in the bidding documents stating that the financial results of the
company are under audit as on the date of techno-commercial bid opening and
the certificate from the practicing Chartered Accountant certifying the financial
parameters is not available.

6.0 GENERAL QUALIFYING REQUIREMENTS
The bidders shall have to necessarily submit the documents in support of meeting the
qualifying requirements as mentioned above along with their offer in COVER-1
(Technical Cover), which inter alia shall include the following:
a. Documentary evidence in support of meeting the qualifying requirements stipulated
above which should include experience of works as specified in QR with self certified
and stamped copies of Work Orders/Award letters with proof of execution in the form of
completion certificate/ final amendment copies/ copy of final bill and other related
documents stating that the work order given in support of qualifying requirements has
been executed.
b. Documentary evidence of having independent PF registration No. from RPF
Commissioner & PAN, and GSTIN No.
c. Proof of Turnover/Balance Sheet duly certified by Chartered Accountant for the last
three years, latest Banker’s Solvency Certificate, Partnership Deed / Affidavit for
Proprietorship / Article of Association including changes in the “CONSTITUTION OF
THE FIRM, (IF ANY)”, (Copy of certification with appropriate authority).
7.0. In case the bidder fails to submit the documents in support of meeting the QR, the
offer shall be liable for rejection. Offer of the bidder not fulfilling the QR shall be rejected
and not considered for evaluation further.
8.0. “ANY BID NOT ACCOMPANIED BY AN ACCEPTABLE BID SECURITY IN A
SEPARATE SEALED ENVELOPE SHALL BE REJECTED BY THE EMPLOYER AS
BEING NON-RESPONSIVE AND RETURNED TO THE BIDDERS WITHOUT BEING
OPENED”.
9.0. Micro and small Enterprises (MSEs) registered with District Industries Centers or
Khadi and Village Industries Commission or Khadi and Village Industries Board or Coir
Board or National Small Industries Corporation or Directorate of Handicrafts and
Handloom or any other body Udyog Aadhaar Memorandum specified by Ministry of
Micro, Small and Medium Enterprises as per MSMED Act 2006 for goods produced and
services rendered, shall be issued the bidding documents free of cost and shall be
exempted from paying Earnest Money Deposit.
The benefit as above to MSEs shall be available only for goods/services produced &
provided by MSEs for which they are registered.
MSEs seeking exemption and benefits should enclose a attested/self certified copy of
valid registration certificate, giving details such as validity, stores/services etc. failing
which they run the risk of their bid being passed over as ineligible for the benefits
applicable to MSEs.
10.0. NTPC Ltd. shall not be responsible for any postal/courier delay, loss or non
receipt of request for issue of tender documents.
11.0. Notwithstanding anything stated above, the NTPC Ltd. reserves the right to
assess the bidder’s capability and capacity to perform the contract, should the
circumstances warrant such assessment in its overall interest and the decision of
NTPC Ltd., in this regard shall be final and binding.

12.0. The last date of sale of bid document is to be considered as the last date of
receipt of request for issue of bid documents. If the last date of sale of bidding
documents falls on a Holiday / Bandh Day the last date of sale of bid documents will
automatically be shifted to next working day.
13.0. NTPC Ltd. reserves the right to reject any or all bids or cancel/withdraw this
Invitation for Bids without assigning any reason whatsoever and in such case no
Bidder/ intending Bidder shall have any claim arising out of such action.
14.0. A complete set of Bid documents may be downloaded by any interested bidder on
payment (non-refundable) of the cost of bidding documents as mentioned above in the
form of a Crossed Account Payee Demand Draft in favour of NTPC Limited, Payable at
SBI Salakati Branch (Branch Code No.-5400). For logging on to the NTPC e-
Procurement Portal (https://eprocurentpc.nic.in), the bidder would require vendor
code, registered email id. First time users not allotted any vendor code are required to
approach NTPC at least Seven working days prior to Document Sale Close date. No
other mode of payment is acceptable.
15.0. Issuance of Bidding Documents to any Bidder shall not construe that such Bidder
is considered to be qualified. Bids shall be submitted online and opened at the address
given below in the presence of Bidder’s representatives who choose to attend the bid
opening. Bidder shall furnish Bid Security, Integrity Pact, Power of Attorney and Joint
Deed of Undertaking(s) (if applicable) separately offline as detailed in Bidding
Documents by the stipulated bid submission closing date and time at the address given
below.
16.0. Transfer of Bidding Documents purchased by one intending Bidder to another is
not permissible.

Clause.
The reference works whose details have been declared as per the specified
format in the relevant attachment (i.e. Attachment No. 3) shall only be
considered to ascertain the bidder's compliance to the specified qualifying
Requirement (QR). Bidders wishing to provide additional reference works are
required to declare the same in similar format which shall be additionally
attached. However, bidders are not permitted to quote more than 3 times the
number of works for this purpose.
The Employer at its discretion may seek any clarification and/ or documentary
evidence only for the reference works as mentioned above. However, no change
or substitution of the reference works by new/additional plant for conforming to
the specified qualifying Requirement shall be sought, offered or permitted.

Replace ITB Clause 12.4 with the following:
The award of the Contract shall be on ‘Works Contract’ basis. The Bidder shall
be responsible for payment of GST levied on the Works Contract Services in
accordance with the applicable Act or Notification(s) by the State or Central
Government or other authorities and rules made there under including
amendments, if any. The liability on account of such tax as per the rates of tax
prevailing as on seven (7) days prior to the date of bid opening shall be included
in the bid price. In case of any variation in the rates of the tax after the date
seven (7) days prior to date of bid opening, the same shall be paid/ reimbursed
to/ recovered from the successful Bidder subject to submission of documentary
evidence and proof of having made the payment at the revised rate and on
certification by Engineer-In-Charge.

It shall be incumbent upon the successful Bidder to obtain a registration
certificate as a dealer under the local Sales Tax Act, Central Sales Tax Act,
Service Tax Law, Works Contract Cess GST Law, and other law(s) relating to
levy of tax, duty, cess etc. and necessary evidence to this effect shall be
furnished by the successful Bidder to the Employer. If the successful Bidder
intends to engage itself in quarrying or mining of soil/ earth, sand, stone/
aggregates, metals, minerals or minor minerals required for the Works, as the
case may be, it shall obtain necessary permits under the applicable law for such
mining or quarrying from the State/Central Government authorities and pay the
fee or charges applicable, thereto.

The Bid Price shall also be inclusive of Service Tax applicable on services such
as Construction Services / Works Contract Services as per the rates prevailing
as on seven (7) days prior to the date of Techno-commercial bid opening. In
case of any variation in the rate of Service Tax during the period of Contract, an
equitable amount shall be payable to / recovered from the successful Bidder to
fully take into account any such change on production of satisfactory
documentary evidence. The Bid Price shall be inclusive of any Royalties,
Seigniorage Fee or cess or other charges payable on the quarried or mined
metal, minerals, or minor minerals, as the case may be, at the rate(s) prevailing

CONTRACT PERFORMANCE SECURITY / INITIAL CONTRACT
PERFORMANCE SECURITY / SECURITY DEPOSIT
1. Within twenty-one (21) days from the date of Letter of Award, the successful
Bidder shall furnish to the Employer a Contract Performance Guarantee (CPG)
towards faithful performance of the Contract for an amount equivalent to 10% of
the Contract Price. Alternatively, the successful Bidder may furnish the Contract
Performance Guarantee in two Stages viz. a Contract Performance Guarantee
for a amount equivalent to 5% of the Contract Price within twenty-one (21) days
from the date of Letter of Award to be followed up with another Contract
Performance Guarantee for an amount equivalent to 5% of the Contract Price
prior to the scheduled completion of 50% of total scope of work.
2. The successful Bidder also has the option to furnish an Initial Contract
Performance Guarantee (ICPG) equivalent to a minimum of 2% of the Contract
Price. In case of the successful Bidder who furnishes Initial Contract
Performance Guarantee, the Employer shall at the time of making any payment
to him for the work done under the Contract, deduct towards the Contract
Performance Security an amount equivalent to 10% of the gross bill amount
accepted for payment until the total amount of Contract Performance Security so
deducted including the amount of Initial Contract Performance Guarantee
becomes equal to 10% of Contract Price.

Add a New Clause 32 as per the following:
BENEFITS /EXEMPTIONS TO SUPPLIES
1.0 Bongaigaon Thermal PP (250x3 MW) has been declared a Mega Power
Project by Ministry of Power, Government of India.
Bidder may accordingly ascertain the availability of the benefits to the
Mega Power Projects by the Government of India. The Employer shall
issue Essentiality Certificate, as per relevant policies of the Govt. of India,
to facilitate the bidder to avail any such benefits on import of goods under
Chapter 98.01 of the Customs Tariff Act, which are required for
incorporation in the works under the contract. For the issue of such
Essentiality Certificate by the Employer, the bidder shall be required to
indicate the import content included in their bid price, in the relevant
schedule provided in the Bidding Documents (Information Questionnaire).
However, the bidder shall himself be solely responsible for availing such
benefits, which they have considered in his bid. In case of failure of the
bidder to receive the benefits partly or fully from the Govt. of India and / or
in case of any delay in receipt of such benefits and/or withdrawal of such
benefits by the Govt. of India, the Employer shall neither be liable nor
responsible in any manner whatsoever.
2.0 Bidder may like to ascertain availability of Customs Duty benefits available
for import of Construction Equipment, if any, as per the extant Customs
Acts and Notifications of Govt. of India. The bidder shall be solely
responsible for obtaining such benefits which he has considered in their
bid and in case of failure to receive such benefits, the Employer will not
compensate the Bidder. The Bidder shall furnish along with their bid,
declarations to this effect in Attachment - 12.
3.0 Where the Bidder has quoted taking into account the Customs Duty benefits
available for import of Construction Equipment, he must give all information
required for issue of relevant Certificate by Employer along with his bid in
Attachment - 12. The relevant Certificate will be issued on this basis only.
The bidder shall be solely responsible for obtaining the Customs Duty
benefits available for import of Construction Equipment from the Govt. of
India. In case of failure of the bidder to receive the benefits partly or fully
from Govt. of India or in case of any delay in receipt of such benefits, the
Employer shall neither be responsible nor liable in this regard in any manner
whatsoever.

Clause 33
Bidders are required to unconditionally accept the "Integrity Pact (IP)" (executed
on plain paper) as per Attachment - 17 to the Tender Documents which has
been pre-signed by the Owner, and submit the same duly signed on all pages by
the bidder's authorised signatory alongwith the bid.

Where the Joint Venture (s) / Consortium are permitted to participate in the bid
as per Qualifying Requirements, the signing of Integrity Pact (IP) by all JV
Partner(s) / Consortium members is mandatory. The Integrity Pact (IP) is to be
submitted in a separate sealed envelope as per provisions of Clause 11.2 (t) of
ITB. Bidder's failure to comply with the aforesaid requirement regarding
submission of "Integrity Pact (IP)" shall lead to outright rejection of the tender
and in such case the tender shall be returned unopened to the bidder. If the
Owner has terminated the contract pursuant to Section-3 of the Integrity Pact
(IP), the owner shall encash the Performance Bank Guarantee/ Security Deposit,
in accordance with Section-4 of "Integrity Pact (IP)"
