3.0Bid Security and Integrity Pact (if applicable) shall be submitted in a sealed envelope separately offline/online by the stipulated bid submission closing date and time at the address given below. Any bid without an acceptable Bid Security and Integrity Pact (if applicable) shall be treated as non-responsive by the employer and shall not be opened.

4.0A complete set of Bidding Documents may be downloaded by any interested Bidder on payment (non-refundable) of the cost of the documents as mentioned above in the form of a crossed account Payee demand draft in favour of NTPC Ltd., Payable at

KAHALGAON or directly through the payment gateway at our SRM Site (https://etender.ntpclakshya.co.in/sap/bc/gui/sap/its/bbpstart). For logging on to the SRM Site, the bidder would require vendor code and SRM user id and password which can be obtained by submitting a questionnaire available at our SRM site as well as at NTPC tender site (www.ntpctender.com). First time users not allotted any vendor code are required to approach NTPC at least three working days prior to Document Sale Close date alongwith duly filled in questionnare for issue of vendor code and SRM user id/password.

5.0Brief Scope of Work & other specific detail

1)SCOPE OF WORK: SUPPLY AND RETROFITTING OF EQUIPMENTS AS PER BOQ AND TECHNICAL SPECIFICATIONS MENTIONED IN THE TENDER DOCUMENTS.

OTHER IMPORTANT TERMS & CONDITIONS:

2) INSPECTION & QUALITY TERMS:

(A)PRE-DISPATCH INSPECTION SHALL BE DONE AT PARTY#S WORKS AS PER APPROVED QUALITY PLAN.

(B)VENDOR TO SUBMIT WARRANTY/GUARANTEE CERTIFICATE VALID FOR A PERIOD OF 18 MONTHS/12 MONTHS FROM DISPATCH/COMMISIONING, WHICHEVER IS EARLIER, AGAINST ANY MANUFACTURING DEFECTS AND BAD WORKMANSHIP.

3) DELIVERY PERIOD: TWENTY FOUR (24) MONTHS FROM THE DATE OF CONFIRM ORDER.

4) PBG: PARTY TO SUBMIT PERFORMANCE BANK GUARANTEE (PNG) FOR 10% OF TOTAL ORDER VALUE.

5) EVALUATION CRITERIA: BID EVALUATION SHALL BE DONE ON "OVERALL/ LUMPSUM BASIS", i.e. Sum Total of Supply + Erection & Retrofitting Charges".

6) PAYMENT TERMS:

(i) FOR SUPPLY PART:

(a) 70% Payment shall be released on receipt & acceptance of material at site.

(b) 20% Payment shall be released on successful testing & Commissioning on Pro-rata basis.

(c) 10% Payment shall be released after completion of #Defect Liability Period# of one year from date of commissioning on Pro-rata basis.

(ii) FOR SERVICE, i.e. RETROFITTING PART:

(a) 100% Payment after successful Commissioning on Pro-rata Basis.

6.0Prospective bidders from U.P. State are compulsorily required to provide TIN number at the time of purchase of bidding documents.

7.0Qualifying Requirements for Bidders:

1.0The bidder should have executed the job of manufacturing, supply, #installation/supervision of installation# and #Commissioning/supervision of commissioning# of at least one hundred (100) numbers of Vacuum Circuit Breakers using its own Vacuum Bottles for 11 kV and/or 6.6 kV level with a rating of 40 kA rms BREAKING, 100 kA peak MAKING and 40 kA withstand for one (1) second for any NTPC stations/SEBs/Govt./Semi Govt./PSU/#NSE or BSE enlisted Company# within the preceding seven

(7) years prior to date of techno-commercial bid opening.

Further, these Circuit Breakers should have been in successful operation in 6.6 kV or higher voltage application for a period of at least two (2) years prior to the date of Techno-commercial bid opening.

2.0The bidder should have executed the job of manufacturing, supply, #installation/supervision of installation# and #commissioning/supervision of commissioning# of Circuit Breakers for 11 kV and/or 6.6 kV level in any NTPC stations/SEBs/Govt./Semi Govt./PSU/"NSE or BSE Enlisted Companies" within the preceding seven (7) years prior to the date of techno-commercial bid opening as per the following criteria:

One order of not less than Rs. 674.4 lakhs

OR

Two orders each of not less than Rs. 421.5 lakhs

OR

Three orders each of not less than Rs. 337.2 lakhs

3.0Average annual financial turnover of the bidder during preceding three (3) financial years prior to the date of techno-commercial bid opening shall not be less than Rs. 421.50 lakhs.

Notes:

(a)The word #executed# mentioned in clause 1.0 and 2.0 means that the bidder should have achieved the criteria specified in clause

1.0 and 2.0 with ANY of the following conditions:

Case-I: The work/order is started earlier (prior to the period stipulated in Clause 1.0 & 2.0), but completed within the stipulated period as mentioned in Clause 1.0 & 2.0. In such cases, entire executed quantity/value of the relevant work vide that work order shall

be considered for evaluation.

Case-II: The work/order is started and completed within the stipulated period as mentioned in Clause 1.0 and 2.0.

Case-III: The work/order is started within the stipulated period as mentioned in Clause 1.0 and 2.0 but not completed as on the last date of stipulated period. In such cases, #In Progress# executed quantity / value of the relevant work vide that work order as on the last date of stipulated period, shall be considered for evaluation.

(b)Any of the cases mentioned in Notes (a) and successful operation as per Clause 1.0 shall be supported by documentary evidence issued by the owner.

(c)Other income shall not be considered for arriving at annual turnover.

(d)In cases where audited results for the last financial year as on the date of the Techno-Commercial Bid opening are not available, the financial results certified by a practicing Chartered Accountant shall be considered acceptable. In case, Bidder is not able to submit the Certificate from practicing Chartered Accountant certifying its financial parameters, the audited results of three consecutive financial years preceding the last financial year shall be considered for evaluating the financial parameters. Further, a Certificate would be required from the CEO/CFO as per the format enclosed in the bidding documents stating that the financial results of the Company are under audit as on the date of Techno-Commercial bid opening and the Certificate from the practicing Chartered Accountant certifying that financial parameters is not available.

8.0Issuance of Bidding Documents to any bidder shall not construe that bidder is considered qualified.

9.0NTPC reserves the right to reject any or all bids or cancel/withdraw the NIT for the subject package without assigning any reason whatsoever and in such case no bidder/intending bidder shall have any claim arising out of such action.
