3.0 Bid Security and Integrity Pact (if applicable) shall be submitted in a sealed envelope separately offline by the stipulated bid submission closing date and time at the address given below. Any bid without an acceptable Bid Security and Integrity Pact (if applicable) shall be treated as non-responsive by the employer and shall not be opened.

4.0 A complete set of Bidding Documents may be downloaded by any interested Bidder on payment (non-refundable) of the cost of the documents as mentioned above in the form of a crossed account Payee demand draft in favour of NTPC Ltd., Payable at Mouda or directly through the payment gateway at our SRM Site (https://etender.ntpclakshya.co.in/sap/bc/gui/sap/its/bbpstart). For logging on to the SRM Site, the bidder would require vendor code and SRM user id and password which can be obtained by submitting a questionnaire available at our SRM site as well as at NTPC tender site (www.ntpctender.com). First time users not allotted any vendor code are required to approach NTPC at least three working days prior to Document Sale Close date alongwith duly filled in questionnare for issue of vendor code and SRM user id/password.

5.0 Brief Scope of Work & other specific detail

1. Scope of Work

1.1.The work is to be executed in NTPC Township area at Mouda STPP.

1.2.Scope of work in this proposal is Construction of Patrolling Road, Drain and Culverts along Boundary Wall, Approach Road and Drain for Substation and OHT and RCC Approach Road for Union Office, School Building (along backside) and Nursery at Township Area, as given in BOQ.

1.3.Work includes:

1.3.1.Jungle Cleaning, Excavation of earth, Carriage of earth & Preparation of bottom of excavation: Jungle cleaning along proposed periphery. Excavation for Moorum filling & WBM preparation & carriage of earth at locations directed by EIC etc. Banking embankment and compaction of earth at locations directed by EIC. Power road rolling & compaction at bottom of excavation.

1.3.2.Moorum filling: Moorum filling 95 % compaction

1.3.3.WBM Road & Berm Preparation: 90-45 and 63-45 mm size WBM Road preparation as per CPWD specification.

1.3.4.Concrete Road, Drain & Box Culvert: Concrete Road on WBM Surface, Drain along Road sides and box culverts at different locations as directed by EIC and as per CPWD Specifications.

1.4. The contractor will deploy required no. of Technical person for proper supervision of the work as per the direction of EIC.

1.5. CPWD Specifications (latest editions) shall be applicable. Wherever, detailed specification of a particular item of work is not available in CPWD Specifications mentioned above, relevant Indian Standard Specification shall be applicable for materials and workmanship. Wherever both CPWD Specifications and IS specifications are not available, work shall be carried out in the best tradition and practices and as directed by the Engineer-In-Charge.

1.6. All bought-out materials shall be in accordance with CPWD/ IS specifications and shall be used subject to approval of NTPC. 1.7. The contractor will make his site office/store at site at his own cost.

1.8. DSR 2012 shall be referred for detailed item description/s for sch. item/s of Bill of Quantity (BOQ).

1.9. The contractor has to comply with royalty reconciliation in every bill and submit royalty clearance Certificate for Mining materials used in the work at the time of Final Bill.

2. WATER & POWER SUPPLY

2.1.NTPC shall provide electric power supply free of cost at one point at site. Agency has to make own arrangements for extra cables required for transfer of point from one place to other at his own cost. If there is load shedding/shutdown/power failure, the agency has to make his own arrangement for power supply at his own cost.

2.2.Supply of suitable water for construction purpose shall be at the scope of the agency at their own cost.

6.0 Prospective bidders from U.P. State are compulsorily required to provide TIN number at the time of purchase of bidding documents.

7.0 Qualifying Requirements for Bidders:

The bidders are required to fulfill the following:

1. The bidder should have executed Road Works involving Water Bound Macadam and RCC Works in the last seven (07) years as on the date of bid opening in:

(a)Single Contract of value not less than INR 364 Lakhs OR

(b)Two contracts of value not less than INR 227 Lakhs each

OR

(c)Three contracts of value not less than INR 182 Lakhs each

The word #executed# means the bidder should have achieved the criteria specified in the above Qualifying Requirements within preceding seven (07) years reckoned as on the last date notified for receipt of techno-commercial bids even if the contract has started earlier/ or is not completed/ closed.

2. Financial Criteria for Bidder:

2.1.The average annual turnover of the Bidder during the preceding three (03) financial years as on the date of techno-commercial bid opening shall not be less than Rs. 455 Lakhs (Rupees Four crore fifty five lakhs only).

2.2.In case the bidder does not satisfy the financial criteria, stipulated at Cl. 2.1 above on its own, its holding company would be required to meet the stipulated turnover requirements at Cl. 2.1 above, provided that the net worth of such holding company as on the date of last day of the preceding financial year is at least equal to or more than the paid-up share capital of the holding company. In such an event, the bidder would be required to furnish along with its Techno-Commercial bid, a Letter of Undertaking from the holding company, supported by Board Resolution, as per the format enclosed in the bid documents, pledging unconditional and irrevocable financial support for the execution of the contract by the bidder in case of award.

2.3.The net worth of the Bidder as on the last day of the preceding financial year should not be less than 100% of the paid up share

capital. In case the Bidder meets the requirement of Net Worth based on the strength of its Subsidiary(ies) and/ or Holding Company and/ or Subsidiary(ies) of its Holding Companies, or as a Consortium/ Joint Venture, wherever applicable, the Net Worth of the bidder and its Subsidiary(ies) and/ or Holding Company and/ or Subsidiary(ies) of Holding Company or as a Consortium/ Joint Venture, in combined manner shall be calculated as follows:

Net Worth (Combined) = (X1+X2+X3)/(Y1+Y2+Y3) x 100

Where, X1, X2, X3 are individual Net Worth which should not be less than 75% of their respective paid up share capitals and Y1, Y2, Y3 are individual paid up share capitals.

2.4.In case bidder is not able to furnish its audited financial statements on standalone entity basis, the unaudited unconsolidated financial statements of the bidder can be considered acceptable provided the bidder further furnishes the following documents in substantiation of its qualification.

2.4.1.Copies of unaudited unconsolidated financial statements of the bidder along with copies of the audited consolidated statements of the Holding Company.

2.4.2.A Certificate from the CEO/ CFO of the Holding Company, as per the format enclosed in the bid documents, stating that the unaudited unconsolidated financial statements form part of the Consolidated Annual Report of the Company.

2.5.In cases where audited results for the last financial year as on the date of techno-commercial bid opening are not available, the financial results certified by a practicing Chartered Accountant shall be considered acceptable. In case, Bidder is not able to submit the certificate from practicing Chartered Accountant certifying its financial parameters, the audited results of the three consecutive financial years preceding the last financial year shall be considered for evaluating the financial parameters. Further, a Certificate would be required from the CEO/ CFO as per the format enclosed in the bidding documents stating that the financial results of the Company are under audit as on the date of Techno-Commercial bid opening and the Certificate from the practicing Chartered Accountant certifying the financial parameters is not available.

Notes:

i.Net worth means the sum total of paid up share capital and free reserves. Free reserves means all reserves credited out of the profits and share premium account but does not include reserves credited out of revaluation of the assets, write back of depreciation provision and amalgamation. Further, any debit balance of Profit and Loss account and miscellaneous expenses to the extent not adjusted or written off, if any, shall be reduced from reserves and surplus.

ii.Other income shall not be considered for arriving at annual turnover.

iii.Reference works executed by the applicant, as a member of Joint Venture/ Consortium/ Associate can also be considered provided: The allocation of scope of work between the partners of the Joint Venture/ Consortium/ Associate is clearly defined in the executed Joint Venture Agreement/ Consortium Agreement/ Deed of Joint Undertaking and the applicant#s scope of work and break-up of quantities executed by them as individual contribution in the Joint Venture/ Consortium/ Associate, duly authenticated by the project authority, meet the relevant provisions of qualifying requirement.

iv.Reference work executed by a bidder as a sub-contractor may also be considered provided the certificate issued by main contractor is duly certified by project authority specifying the scope of work executed by the sub-contractor in support of the qualifying requirement.

8.0Issuance of Bidding Documents to any bidder shall not construe that bidder is considered qualified.

9.0 NTPC reserves the right to reject any or all bids or cancel/withdraw the NIT for the subject package without assigning any reason whatsoever and in such case no bidder/intending bidder shall have any claim arising out of such action.

11. Initial steps for participating in our E-tender are as mentioned below: 11.1. Vendors already having SRM Vendor Code and Password

Before downloading/ viewing the tender document, bidder has to pay requisite tender fee either through payment gateway by clicking on #pay tender fee# after login in our SRM site or send D/D to us directly, which should reach us at least three working days prior to Last Date of Tender Fee Payment.

11.2. Vendors already having SAP Vendor Code, but do not have SRM login ID and Password

11.2.1.Duly filled Annexure-2 (format given under #Guidelines to Bidders# in NTPC e-tender website) should reach us at least five working days prior to Last Date of Tender Fee Payment.

11.2.2.Before download/ viewing the tender document, bidder has to pay requisite tender fee either through payment gate way by clicking on #pay tender fee# after login in our SRM site or send D/D to us directly, which should reach us at least five working days prior to Last Date of Tender Free Payment.

11.3. New Vendor neither having any vendor code in SAP nor any SRM login ID and Password

11.3.1.Duly filled Annexure-1 (format given under #Guidelines to Bidders# in NTPC e-tender website) and PAN card scanned / photo copy (Self Attested) along with the detailed address should reach us at least five working days prior to Last Date of Tender Fee Payment.

11.3.2.Before downloading/ viewing the tender document, bidder has to pay requisite tender fee either through payment gate way by clicking on #pay tender fee# after login in our SRM site or send D/D to us directly, which should reach us at least five working days prior to Last Date of Tender Fee Payment.

11.3.3.First time users not allotted any vendor code are required to approach NTPC at least five working days prior to Document Sale Close Date along with duly filled in questionnaire for the issue of vendor code and SRM user ID/password.

3.Benefits to Micro & Small Scale Industries

Micro and Small Enterprises (MSEs) registered with District Industries Centres or Khadi and Village Industries Commission or Khadi and Village Industries Board or Coir Board or National Small Industries Corporation or Directorate of Handicrafts and Handloom or any other body specified by Ministry of Micro, Small and Medium Enterprises as per MSMED Act 2006, for goods produced and services rendered, shall be issued the bidding documents free of cost and shall be exempted from paying Earnest Money Deposit. Such parties can sent the request for Tender Documents along with a photocopy of valid registration certificate preferably attested by Gazetted Officer/ Ist Class Magistrate/ notarised, giving details such as validity, stores and monetary limits, failing which they run the risk of their bid being passed over as ineligible for this concession. The documents with regard to the same should reach us at least three working days prior to Last Date of Tender Fee Payment.
