3.0 Bid Security and Integrity Pact (if applicable) shall be submitted in a sealed envelope separately offline by the stipulated bid submission closing date and time at the address given below. Any bid without an acceptable Bid Security and Integrity Pact (if applicable) shall be treated as non-responsive by the employer and shall not be opened.

4.0 A complete set of Bidding Documents may be downloaded by any interested Bidder on payment (non-refundable) of the cost of the documents as mentioned above in the form of a crossed account Payee demand draft in favour of NTPC Ltd., Payable at Not Given. or directly through the payment gateway at our SRM Site (https://etender.ntpclakshya.co.in/sap/bc/gui/sap/its/bbpstart). For logging on to the SRM Site, the bidder would require vendor code and SRM user id and password which can be obtained by submitting a questionnaire available at our SRM site as well as at NTPC tender site (www.ntpctender.com). First time users not allotted any vendor code are required to approach NTPC at least three working days prior to Document Sale Close date alongwith duly filled in questionnare for issue of vendor code and SRM user id/password.

5.0 Brief Scope of Work & other specific detail SALIENT TECHNICAL FEATURES

Sub: Transportation contract of general cargo for two years, TSTPS, NTPC Kaniha.

SALIENT TECHNICAL FEATURES:

Talcher Super Thermal Power Station is a Unit of NTPC, in Kaniha block under Talcher sub- division of Angul district of ODISHA.

SCOPE OF WORK

The scope of work involves the Transportation of all types of materials (except tanker loads and explosives) booked to NTPC/TSTPS by various agencies or individuals from any where in India to Talcher Super Thermal Power Station, Kaniha & vice versa.

SPECIAL CONDITIONS OF TRANSPORT CONTRACT

01. Sufficiency of Tender:- The contractor shall be deemed to have satisfied himself before tendering as to the correctness and sufficiency of his tender for the works and of the rates and prices quoted in the schedule, cover all his obligations under the contract except otherwise provided for.

02. #Owner#/Corporation/NTPC shall mean the NTPC Ltd., New Delhi having its registered Office at NTPC Bhawan, Scope Complex, Lodhi Road, 7, Institutional Area New Delhi # 110003 and shall include their legal representatives successors and permitted assigns.

03. The contract shall mean the notice inviting tender, the tender and acceptance thereof and the formal agreement if any, executed between the National Thermal Power Corporation Ltd., and the contractor together with the documents referred to therein including these conditions with appendices and any special conditions, the specification, designs, drawings, schedule of quantities with rates and amount and schedule of rates. All these documents taken together shall be deemed to form one contract and shall be complementary to one another. Several documents forming the contract are to be taken as mutually explanatory to another. If there are varying or conflicting provisions made within the documents forming part of the contract, the owner shall be the deciding authority with regard to the intention of the document(s).

04. The contractor shall mean the individual or firm or company whether incorporated or not, undertaking the works and shall include legal representatives of such individual or persons comprising such firm or an incorporated company or successors of such firm or company as the case may be and permitted assigns of such individual or firm or company.

05. The contract sum shall mean the cost of the works arrived at after extension of the rates shown in the schedule by the quantities for various items during contract period.

06. Engineer-in-charge shall mean HEAD/INCHARGE OF STORES or authorities above him or his authorized representative who shall direct, supervise and be in-charge of the works for purposes of this contract.

07. The work shall mean the works to be executed in accordance with the contract part(s) thereof, and as required for performance of the contract.

08. The terms material, stores, shall mean and include plant, equipment, stores to be transported by the Contractor under the contract.

09.i) Brief Purchase Order / Purchase Order shall mean the official notice issued by the owner notifying the contractor that his proposal has been accepted.

ii)The date of contract shall mean the date of start as indicated in Brief Purchase Order or Purchase Order.

10.The duration of contract shall be normally for a period of two years commencing from the date of start mentioned in LOA, unless terminated earlier as provided herein. The contract would be deemed to have been completed when the time period of the contract is completed. On receipt and acceptance of transport contract the transporter shall set up office & godown etc. NTPC Ltd. reserves the right to extend the contract at same rate, terms & conditions if so desires for a further period of three months.

11.The quantities if any mentioned in the tender schedule are approximate and no guarantee can be given of any definite volume of work which will be entrusted to the contractor at this time or throughout the period of contract. Work load depends upon the availability of materials for road transportation and/or delivery orders issued by the suppliers or booked by the suppliers or from other NTPC projects. The contractor will have to execute the work for the quantity made available during the currency of the contract at the rates accepted and no financial liabilities will be accepted by NTPC.

12.The materials dispatched /booked during the currency of the contract which are yet to arrive at the destination shall have the coverage and shall be governed by the rates terms and conditions of the contract.

13.Income Tax deduction and other statutory deductions will be made as per the rule and regulations in force in accordance with the Income Tax act and other statutory rules prevailing from time to time.

14.The rates are applicable to all consignments booked to NTPC or vice versa, irrespective of its value, on actual weight basis.

15.The minimum charges for each consignment of smalls shall be Rs.280/- subject to the condition that the consignment is door delivered, otherwise rates shall be applicable as per actual weight or by volume as the case may be.

16.The contractor shall submit the bills in triplicate every thirty days complete in all respects as required by Engineer- in-charge. Original consignee copy and third copy of way bill should be attached with the bills. Payment will be made within 30 days of presentation of bill. If consignments are delivered without original documents i.e. original consignee copy, third copy of way bill etc., then payment will be released against receipted destination copy from the stores containing CISF stamping. But the way bills issued to the transporter has to be reconciled periodically.

17.(a) All consignments shall be booked invariably on weight basis. Single consignment weighing 7 MT or above shall be automatically considered as full truck load and payment shall be released for 9 MT and single truck deemed to have been used exclusively for transportation of this consignment alone. Any single consignment weighing less than 7 MT shall be considered as smalls unless written permission of NTPC is obtained prior to loading for considering as full truck. Normally weight of 9 MT is considered as full truck load and 22 MT for Full Trailer load. In case of volumetric consignments, where calculation of volume is difficult, certification by Engineer-in-charge shall be obtained for consideration of full truck load/trailer load. Mini truck load will be considered for 6 MT when it will be advised so.

(b). Wherever in the terms & conditions of the contract it is mentioned as Full Trucks the same implies six wheeler of 09MT capacity. Single consignments weighing more than 11 MT, when transported by ten wheeler truck of 16 MT capacity (TORUS), then payment will be made for 16 MT.

18. On written permission from NTPC representatives, the consignments below 9 MT/ 22MT can be considered for loading as full truck/ trailer load for expeditious delivery at our Stores. If small loads dispatched as full truck load to meet urgency of requirements are not delivered within the period of transit these will be treated as small consignments and freight charges will be paid for actual weight of the consignments.

TRANSIT TIME :

A : FOR FULL TRUCK LOADS : 1 DAY FOR EVERY 200 KM.

B : FOR TRAILOR LOADS : 1 DAYS FOR EVERY 175 KM.

C : SMALLS SHALL BE DELIVERED AGAINST 15 DAYS OF INTIMATION.

Date of loading and unloading shall not be considered in transit time.

19. a). Imported and indigenous single consignment valuing more than Rs.20.00 Lakhs irrespective of weight of the consignment can be booked as Full Truck (09 MT) basis. In such cases single truck shall be deemed to have been used extensively for transportation of the consignment/ consignments are to be delivered at NTPC Kaniha on Door delivery Basis. If the above consignment/ consignments are not delivered with the period of transit, the same shall be treated as small consignment & freight charges shall be paid for actual weight of the consignments. The rate schedule contains for door delivery only. All the consignments will have to be door delivered even if it is booked up to transporter#s godown & some other place. In case transporter fails to deliver the consignments at stores, recoveries towards three times cost of collection of consignments will be made from transporter.

b). If the total consignment weight is more than 09MT, it is to be booked on actual load basis irrespective of value.

20.If the weight exceeds 9 MT/ 22 MT for truck/trailor payment will be made prorata for the excess weight. However NTPC shall not be liable legally for carrying excess weight permitted by laws of state Govts./ GOI.

21.RATES FOR UNSPECIFIED STATIONS APPLICABLE FOR GENERAL CARGO

The rates payable to the transporter for unspecified stations shall be on weight basis per KM basis for the shortest distance between unspecified station and the nearest specified station indicated in the schedules certified by Automobile association of India plus the rate indicated for specified station in the schedule. RATES APPLICABLE FOR VOLUMETRIC CONSIGNMENTS: GENERAL CARGO Unless otherwise stated, one cu.ft = 20 kg. or Cu.Mtr # 740 Kg.

22. In the event of contractors unsatisfactory performance failure to commence the work/effect delivery on the due date or time, the Corporation reserves the right to rescind/cancel the contract and claim the losses incurred by Corporation as decided by the Corporation and/or any alternative mode of execution of contract in consideration of such failure. For unsatisfactory performance, 15 days notice would be given for termination of the contract. If the work is found to be unsatisfactory or if the contractor commits defaults in complying with any of the terms and conditions of contract, NTPC reserves the right to terminate the contract at any stage with 15 days notice and can get the work done by another agency at the risk and cost of the contractor accorded with the work initially.

Termination of contract for death : If the contractor is an individual or a proprietary concern and the individual or the proprietor dies and if the contractor is a partnership concern and one of the partners dies then unless the accepting authority is satisfied that the legal representatives of the individual contractor or of the proprietor of the proprietary concern and in the case of partnership, the surviving partners, are not capable of carrying out and completing the contract, accepting authority shall be entitled to cancel the contract as to its in-completed part without the Corporation being liable any way for payment of any compensation to the estate of the contractor firm on account of the cancellation of the contract. The decision of the accepting authority that the legal representatives of the deceased contractor or the surviving partners of the contractor firm cannot carry out and complete the contract shall be final and binding on the parties. In the event of such cancellation, the corporation shall not be held the estate of the deceased contractor and the surviving partners of the contractors firm are liable for damage for not completing the contract. Any refusal on intimation by NTPC suppliers or refusal of transporter to book materials shall be viewed very seriously. Local representative of transporter shall sort out the problem within 7 days of intimation of NTPC failing which "twice the difference of freight between alternate transporter#s charges and as per contract charges" shall be deducted from contractor#s bills.

23.The contractor shall not be entitled to any increase on the contract rates or any other or claim whatsoever by reason of any representation, explanation or statement or guarantee given or alleged to have been given to him by any person. The prices as agreed shall remain firm throughout the contract except for variation in diesel price. The owner will increase or decrease the agreed transportation rates @ 0.3% per every 1% increase or decrease in base diesel price due to any Govt. notification etc. Price of diesel prevailing 7 days before the date of bid opening, shall be considered as base price.

24.The contract either in full or in part shall not be sublet, transfer or assign or shall transfer be made by power of attorney by authorising others to receive payment on behalf of the contractor without the previous written approval of the Engineer-in- charge.

25.The normal working hours of stores at NTPC site are from 8.30 am to 5.30 pm with usual lunch break for one hour between 1 PM to 2 PM and the materials will be allowed to be unloaded only during the working hours and on working days only. It is the responsibility of the transporter for smooth and proper entry of materials keeping in view the rules and regulation of entry of materials at main gate. Covering letter containing challan no, LR no. Xerox copy of challan and LR should be submitted to CISF at the main gate for all consignments. In very exceptional cases the Engineer-in-charge at his discretion may relax the working hours. NTPC may change the working hours/lunch break hours without any notice. The transporter will make his own arrangement for stay of his employees or labourers. The transporter will be responsible for any kind of injuries or accidents caused to his employees or labourers and corporation shall not be liable in the matter. The trucks shall not be allowed into NTPC premises after 13.00 hours. However,

trucks already inside will be unloaded till 17.00 hours.

26.The transporter shall be responsible for all losses or damages due to any cause whatsoever except for force majeure from the time they receive the consignment till the time consignments are delivered to consignee. The transporters will have to take adequate precautions for transporting hazardous goods as per rules in force. They would be fully responsible for any mishap on the way and would compensate the corporation fully for any loss, damage or shortage to the consignments/ packages, besides other penalties of Government. The corporation will not be responsible for any claim, damage, loss to the property and/or person or transporter assigning out of such mishaps. The transporter/ his agent on demand by the owner, shall furnish the owner with shortage/open delivery certificate in case of such shortages/damages, the contractor shall also arrange for insurance survey by a competent person within the permissible time limits. In case of accidents, fire, theft etc. if any while loaded with owner materials ( or material in the custody of the contractor before shipping), resulting of any kind of damages to the contents or to the packing necessary formalities like, lodging of FIR, panchanama , intimation to owner, consignee etc. and arranging loss will be done by the contractor. Indemnity: The contractor shall be fully liable to make good all losses suffered by the NTPC Ltd due to damage or non delivery of the material entrusted to the contractor for transport. Contractor's liability is full and absolute in all circumstances.

27.NTPC shall not be responsible in any way for any loss or damage incurred and injuries sustained by the contractor, his agent and other persons engaged by him to carry-out the contract. All materials shall be carried at carriers risk and not Owner Risk and complete responsibilities from every angle shall rest with the transporter from the time of lifting of the materials till the final delivery at destination station.

28.The transporter should deliver all the consignments at NTPC stores on door delivery basis on production of LR/GR/Indemnity Bond/authorisation. Unloading is NTPCs responsibility. The contractor shall agree to deliver the material transported by him to the owner even in the absence of the LR, based on the authorisation letter issued by the owner. However, the LR and other documents will be surrendered to the contractor within a reasonable time of their receipt.

29.Only during emergencies materials will be collected at transporters godown in such cases loading of the consignments into NTPC trucks shall be done by the transporter free of cost. In addition to this the transporter shall quote rebate on freight charges for such collections.

30.If materials are booked/wrongly booked/ transported to incorrect destinations, such as Dhenkanal, Angul, Talcher, Cuttack, Bhubaneswar, or to/at any other place, all the expenses for its redirection or otherwise shall be to transporters account. Apart from above, intimation of such consignments shall/ may be provided by NTPC to the transporter in writing and such consignments should be delivered to stores within 10 days from the date of receipt of intimation.

31.Consignments of all outward dispatches shall be collected by the transporter from our stores at lump sum rate of Rs.100/- per consignment as collection charges.

32.The transporter have to collect the imported consignments from different ports like Delhi, Visakhapatnam, Calcutta, Bombay, Paradeep port etc. The actual location and persons concerned (clearing agent) port wise shall be intimated later on.

33."Imported consignments from Delhi, Bombay, Madras and Calcutta & BBSR to be collected by contacting the respective T&CC offices of NTPC. For all imported items booked by T&CC offices of NTPC, the Transporter must return the TP (transport pass) after getting them duly endorsed by officials at respective State borders. Any penalty if imposed on NTPC due to noncompliance of above TP formalities by the Transporter shall be to the account of the Transporter".

34.(a) Detention charges per day: 24 hours beyond first 24 hours detention from the date and time of placement of vehicles at NTPC/TSTPP will be paid at Rs. 500.00 / 1000.00 per day for truck/ trailer if the truck/trailer reports to stores before 1.00 P.M on any working day.

(b) Reporting & issuing date of waybill shall be recorded by the driver from our agency stationed at each border check post. In case of non-availability of waybill at border, detention charges will be considered after first 12 hours of reporting @ Rs.500.00/ Rs.1000.00 per day (24 hours) in case of truck and trailor respectively.

35. If the transporter fails to successfully complete transportation work within the transit time fixed under the contract, the contractor shall pay to the owner as liquidated damages of Rs.5/- (Rupees five only) per MT per day for delay in delivery beyond the transit period agreed by the Contractor except in case of Force majeure conditions for truck/trailer loads. In case of smalls LD shall be levied @ 2% of freight amount per day subject to a maximum of 25% of freight amount for the delay beyond stipulated transit time. The date

of LR and the date of unloading shall be excluded for this purpose.

36.In case notice is given and transporter does not place the truck within 2 days, the transporter has to pay Rs. 500/- per truck per day and Rs. 1000/- for trailer per day subject to maximum of Rs.2500/-for truck & Rs 5000/ for trailer. In addition, NTPC reserves the right to get the transportation job done through other transporters at transporters risk and cost and in such case all additional expenditure involved including twice the freight difference shall be recovered from transporters bills.

37.The contractor shall be liable for payment of any demurrage/ wharfage charges or any other kind of extra expenditure, which may occur in case the contractor fails to place the requisite number of vehicles within docks/factory/godown/business premises from where the material is to be transported. 38. Force majeure is herein defined as any cause which is beyond the contractor or the owner, as the case may be, which they could not foresee or with a reasonable amount of diligence could not have foreseen and which substantially affect the performance of the contract, such as :-

a)Natural phenomena, including floods, draughts, earthquakes and epidemics.

b)Acts of any Government including war declared or undeclared priorities, quarantines, embargoes. Provided either party shall within fifteen days from the date of occurrence of such act notify the other in writing of such causes, or at the same time documentary evidence in this regard should be produced.

39.The contractor or the owner shall not be liable for delays in performing his obligations resulting from any force majeure clause as referred to and/or defined above.

40.The contractor shall place suitable number of vehicles as desired at the required time and place/arrange to collect the material within 48 hours of the notice served on him by the owner/his agency/supplier, having valid and genuine interstate permits and other relevant documents etc., so that loading can be done in accordance with the programme decided by the owner. Arrangements for loading the materials will be made by the authorities of stock yards/clearing agents or any other agency appointed by the owners and at the consignee destination shall be arranged by the concerned authorities at the destination.

41.The contractor or their authorised representatives shall witness measurement/weight and loading of materials into each vehicle and acknowledge receipt of the same on the challan/other documents presented to their representative present at the time of loading and issue the GR as a token of having received and loaded the said materials in the vehicles in good condition. The contractor shall be responsible to take delivery of entire quantity of materials as per the delivery orders handed over to them from time to time within its validity period.

42.The description of good and no. of pieces/packages/measurement/ weight dispatched in a vehicle must be clearly indicated in the relevant GRS and physical delivery should be effected at the destination by counting/weighing. The contractor should obtain acknowledgement for receipt of materials from authorities at destination on drivers copy of the GR which shall be treated as final qty. received. The contractor shall be responsible for daily status of collection of materials giving Truck No. GR/LR. No. & Dt., challan no. of clearing agent/stock yard holders or any other authorities (appointed by the owner and expected time of arrival at destination to the consignee). NTPC re- serves the right to weigh or reweigh the consignments and demand open delivery.

43.In case owner desires to provide escorts along with the consignment the transporter shall be responsible for making necessary arrangement for the same without any extra cost to owner.

44.The contractor shall maintain all statutory registers and records in proper manner as required by the regulation of various concerned authorities. The owner and the consigned shall not be responsible for any consequences due to any incorrect and/or faulty documentation on the part of the contractor.

45.No transshipment of materials enroute shall be allowed for full truck/ trailor load except incase of accidents/break downs. In such events, the extra cost there of, will be to transporter's A/C.

46.The contractor shall transport the material by shortest motorable route and shall be responsible to provide authentic proof to owner for such shortest route and distance between loading and unloading points, i.e. place from where delivery is taken and place where materials have been delivered. To arrive at distance for shortest motorable routes between two points, the reference shall be drawn from Govt. road maps or/and other relevant publication or certification of Automobile Association of India.

47.The contractor shall be responsible for payment of all Indian duties, levies & taxes (except service tax) in respect of the transaction between NTPC Ltd. & Contractor.

48.No octroi charges are normally payable by owner for the materials, being Govt. cargo. For this purpose the contractor is the authorised representative and represents the same to the concerned authorities for claiming exemption. Octroi charges if paid wrongly by the contractor shall not be reimbursed by owner.

49.Contract performance Guarantee :- As a contract security, the contractor(s) to whom awarded is/are required to furnish a Performance guarantee from Nationalised Bank in proper proforma in favour of the owner for a value of 10% of total contract price within 15 days from the issuance of Purchase Order towards faithful performance of the contract.

Further 10% of the running bills will be deducted towards additional CPG when the value of transportation executed exceeds the total contract price at any point of time. This contract performance guarantee shall be valid till the expiry of 90 days after the end of the contract. The performance guarantee will be returned to the contractor without any interest on the expiry of 90 days after the contract period specified in the documents or settlement of bills whichever is later.

50.The contractor shall mobilize his resources immediately on the receipt of communication from the Engineer-in-charge.

51.The contractor shall employee his own driver, cleaners, supervisors and all labour required for satisfactory execution of the contract. The contractor should make his own arrangements to procure the tools and equipments required for carrying out the work as per the contract. No tools and equipments will be provided by NTPC Ltd.

52.The transporter shall intimate the arrival of materials in advance so that NTPC can make arrangements to receive the same.

53.Observance of Rules/Regulations : Any contravention by the contractor or any person employed by him or acting on his behalf of any of the terms of contract or any of the provisions of act, Rules, Regulations formulated by supplier and or NTPC Ltd., would be communicated in writing to the contractor or to the person acting on his behalf by the Engineer-in-charge. After having been informed of such contravention if the contractor fails to take appropriate action, supplier/NTPC limited has the right to refuse entry to the persons responsible for such contravention to the permissions of Supplier/NTPC Ltd., till the cause of such contravention is removed or the contractor has informed in writing of the corrective action taken by him.

54.The transport contractor shall allow NTPC's representative to be present at the time of loading the material and also accompanying the trucks from supplier#s factory to TSTPP, Kaniha.

55.Insurance: The insurance of the consignments to be transported from various places all over the country to TSTPP and vice versa will be covered either by the consignor or by the consignees. Transporter will issue Open Delivery Certificate (ODC) and 'Certificates of Facts' (Damage/shortage certificates) in case of damages or shortages and the claim amount will not be deducted from the freight bills. These certificates will have to be issued within 15 days of receipt of claim letter along with necessary documents, positively. However in the event of non-settlement of claims partly or fully, due to the reasons attributable to the transporter, the recovery is to be made subsequently from the transporter. Freight for such consignment will be paid only after submission of such certificates by contractor to Engineer-in-charge.

56.Defense of Suits : If any action in court is brought against the owner or an officer or agent of the owner for the failure on the part of the contractor to perform any acts, matters, contents or things under the contract or for damages on injury caused by the alleged commission or negligence on the part of the agent, representatives or sub agents, workmen, suppliers or employees the contractor shall in all such cases indemnify and keep the owner and/or his representatives indemnified from all losses damages, expenses for all cases arising out of such action.

57.Contractor shall intimate NTPC on weekly basis the dispatch details at his own cost. The transporter shall set up/open godown & office at Kaniha or Talcher or Angul within 21 days of placement of award. The transporter's representative shall visit NTPC stores every week with the list of consignments lying with them. The representative shall handover the same to stores in-charge and also will collect the list of the LRs lying with NTPC and indicate the status of these in next visit.

58.Arbitration : In the event of any question, dispute or difference arising under these conditions or in connection with this contract the same shall be referred to the sole arbitration of an arbitrator appointed by the Head of the station. It will be no objection that the arbitrator is a Govt. Servant and that in the course of his duties as Govt. servant he has expressed view on all or any of the matters in dispute /difference. In the event of such an arbitrator to whom the matter is originally referred being transferred or vacating his office by resignation or otherwise or becoming unable to act, Head of station shall appoint another person to act as arbitrator in accordance with the terms of this agreements. Such person shall be entitled to proceed from the stage at which it was left by his predecessor. The award of arbitrator shall be final and binding on the parties. It is further a term of this contract that no person other than the person

appointed by the HOP of the Corporation as aforesaid should act as arbitrator.

The arbitrator may from time to time with the consent of all the parties to the contract enlarge the time for making the award. The venue of the arbitration shall be decided by the arbitrator, subject to Indian Arbitration Act, 1940 and the Rules there under and any statutory modification thereof shall apply to the arbitration proceedings in this clause.

59.Laws governing the contract: This contract shall be governed by the Indian Laws for the time being in force. The court at Talcher shall have exclusive jurisdiction in all matters arising under this contract.

60.If any materials of NTPC is likely to attract octroi at Talcher, Angul, Dhenkanal, Cuttack, Bhubaneswar; the same shall be door delivered to NTPC Kaniha immediately upon receipt of materials or receipt of communication from octroi authorities. Transporter shall obtain indemnity/authorisation from NTPC where LR could not be exchanged. As the charges are inclusive of all, no enroute octroi is payable by NTPC.

61.The materials shall be stacked properly at the transporter godown till they are handed over to NTPC. The materials shall be handled properly during loading and unloading. Further all materials shall be stored in covered storage space to avoid damage in performance in future.

62.You are required to obtain license from the appropriate licensing authority u/s 93(i)(ii) of MV Act 1988 towards "dealing with business of transportation of goods by goods carriage of collecting, distributing & forwarding of goods".

63.The rate schedule contains rates for full load (9MT) trucks for a specified station and for unspecified distance from specified station. The following multiplication factors are applicable to full truck load rate per MT to arrive at the rates of the following.

The normal dimensions of truck is 18 ft x 7ft x 6.6ft. The size of the consignment that can be allowed for trailor load is :

Length = More than 22 ft.

Width = More than 7.0 ft.

Height = More than 7.0 ft.

Minimum chargeable weight for trailor is 22 MT

However written consent from Engineer-in-charge must be taken before loading any materials on trailer. Open load is payable for trucks on infringement of length or width or both beyond above specified dimensions. However NTPC is not legally liable for any infringement on account of weight and dimensions of cargo.

64.FOR CONVENIENCE THE RATES FOR SMALLS SHALL BE IN MT. HOWEVER THE RATES SHALL BE APPLICABLE ON PROPROTIONATE BASIS i.e. PER KG BASIS.

65.NTPC will deposit the required service tax (as per applicability) on production of LR challan/bills.

66.Environmental guidelines for transportation of hazardous chemicals, oils, waste.

ØPlease ensure compliance of relevant notification/statutory requirement issued by government with regards to environments.

ØMotor vehicle Act. 1989 with its amendments must be followed strictly as applicable.

ØAll vehicles should have valid Pollution Under Control (PUC) certificate whenever applicable.

ØTo train drivers to handle emergency situations during transportation.

ØTo make aware concerned driver/staff the dangers related to transportation of hazardous materials.

ØThe driver should have transport emergency cards with him whenever applicable.

ØMaintenance agencies/drivers should known of environmental impacts arising from their activities pertaining to the use of fuel, lub oils, its spillage, disposal of various harmful items used in automotive vehicle and similar other operations, are going to affect the

environment.

ØYou must be made aware your drivers/staff about consequences of over loading and under loading from specified norms so that optimum use of vehicle can be availed.

ØAll vehicles should be kept in proper maintained conditions and for this periodic and preventive maintenance/service should be done whenever necessary.

ØAll drivers/concerned staff should be well aware about material Safety data Sheet (MSDS) of the hazardous chemicals/oils they are carrying and it must be implemented whenever applicable.

ØEnsure for awareness and training for above amongst your employees whenever required.

67. Following is the bid evaluation criteria for subject tender.

All 127 destinations in the BOQ for both small and full truck loads i.e. total 254 locations shall be considered for evaluation of bids and the two lowest bidders for maximum destinations (out of 254 locations) shall be considered as evaluated L1 bidders#

NTPC reserves the right to split the contract between two evaluated L1 bidders#

SERVICE SPECIFICATIONS

10 .10 - Total ceiling value of the contract

The total ceiling value of the contract as per enclosed Bill of Quantity.

6.0 Prospective bidders from U.P. State are compulsorily required to provide TIN number at the time of purchase of bidding documents.

7.0 Qualifying Requirements for Bidders:

1.0 TECHNICAL CRITERIA :

(i) a) The bidder should be a bank approved transporter.

b) The bidder shall have an office & godown at Angul or Talcher or at Kaniha.

c) The bidder shall have offices at not less than 90 locations out of 127 locations indicated in the tender documents and also cover more than 200 stations throughout India. The branch list to be submitted along with tender documents as proof of branch address.

(ii) The bidder should have executed/ completed similar contract during last seven (7) years ending last day of month previous to the date of NIT having minimum contract values as indicated below :

(i)One contract of value not less than Rs.96 Lakh OR

(ii)Two contracts of value not less than Rs.60 Lakh each OR

(iii)Three contracts of value not less than Rs.48 Lakh each Similar Contract means road transportation contract.

2.0 FINANCIAL CRITERIA:

Turn over : The average annual turnover of the bidder in the preceding three (3) completed financial years ending with Financial year 2013-14 as on the date of bid opening shall not be less than Rs.60 Lakhs.

NOTES :

1. The word #executed# means that the bidder should have achieved the progress specified in the QR even if the total contract is not completed / closed. The same shall be supported by documentary evidence issued by the owner.

2.Other income shall not be considered for arriving at annual turnover.

3.In cases where audited results of the last preceding financial year are not available, certification of financial statements from a practicing Chartered Accountant shall also be considered acceptable.

8.0Issuance of Bidding Documents to any bidder shall not construe that bidder is considered qualified.

9.0 NTPC reserves the right to reject any or all bids or cancel/withdraw the NIT for the subject package without assigning any reason whatsoever and in such case no bidder/intending bidder shall have any claim arising out of such action.

IV. Earnest money deposit (EMD):

A. Bid Security/EMD and LOU shall be submitted in a sealed envelope, which should be superscribed #Maintenance Contract of Desktop computers for a period of 02 years in NTPC, TSTPS#, NIT ref no. 40037327, Due on date: __.__.2015 from

_________________________ (Name and Address of bidder).# , separately offline by the stipulated bid opening date and time at the address given below. Any bid without an acceptable Bid Security (if applicable) shall be treated as non-responsive by the employer and shall not be opened.
