OR The owner shall submit Undertaking that they will buy a new jeep and deploy within 15 days from the date of confirmation of order complying with all statutory requirement and submit the document indicated above and all other terms and condition of jeep deployment.

ENVELOPE NO.03: Should contain the priced bid. However price bid of only successful bidder (w.r.t. QR and technically) shall be opened on later date with prior intimation.

The bidders name and address be mentioned on each of the above three envelopes with the tender number and name of work etc. In case of sending offer by post, the above envelopes can be put in one main cover/envelope with the superscription on top of envelope that inside there are three separate sealed/ closed envelopes: one for EMD, Letter of undertaking, second Technical credentials & third for priced offer.

Please note that in case any discrepancies found in submission of tender, your offer/ price bid is likely to be not opened. The decision of NTPC in this regard shall be final and binding on you.

NTPC GCOC (latest print) along with its amendment is also a part of tender document, which may be seen at Contract Services. If required a copy may be obtained from Contract Services. A set of tender paper for the work is also enclosed for your ready reference and necessary action.

The time of completion of work is Two years i.e. 731 days.

2.0 Tender documents shall be issued free of cost to all the bidders on request willing to deploy vehicle in NTPC.

3.0 All bids shall be accompanied by a Bid Guarantee (EMD) as mentioned above (except PAPs). Bids not accompanied by the requisite bid guarantee in a separate sealed cover or bids accompanied by bid guarantee of inadequate value shall not be entertained and in such cases bids shall be returned to the bidders without being opened.

4.0 QUALIFYING REQUIREMENTS FOR BIDDERS:

(a) Bidder to deploy diesel driven jeeps (Closed Hard Top) on hire basis of model not earlier than Jan 2012. In case of PAPs of NTPC, vehicle model of Jan 2010 onwards will be acceptable.

OR

Bidder may also buy new diesel driven jeeps (Closed hard top) and deploy within 15 days from the date of confirmation of order (Formal Award Letter)

(b) Besides, the bidder will give undertaking for following which will be indicated in the tender documents :

i) Bidder shall cover insurance comprehensively as per commercial norms at his cost.

ii) The vehicle should have valid Taxi Permit/License from RTO.

iii) Bidder shall take Service Tax registration, PAN No. within 15 days from the date of award at his cost.

iv) The jeep deployed shall have all commercial tax to be borne by the bidder.

v) All other statutory requirements for running the vehicle on hire basis to be borne and fulfilled by the bidder

5.0 Other Terms and Conditions to be given along with NIT / tender shall be as follows:

a. The bidder / owner shall comply with QR part-b, within 15 days time of award, failing which contract may be terminated & EMD shall be forfeited.

b. The party has to offer their best offer for 12 / 24 hrs deployment in tender form. All the interested parties / persons has to submit their offer. Failing which their vehicle will not be considered for deployment in first phase.

c. Based on rate received, NTPC committee shall do analysis and fix the rate. After fixation of the rate counter offer will be given to the parties for acceptance of the fixed rate. On acceptance by the party the order will be processed as per priority list given in following clause 5(e).

d. PAPs (Project affected persons) qualified as above & who had already deployed jeeps earlier in NTPC Korba shall be given first priority.

e. Priority list for vehicle deployment shall be on quoted rate in the tender. Deployment will be based on relative position in tender, in chronological order i.e. deployment list shall be prepared based on L-1, L-2, L-3, .... to L-24 etc. position of Bidder. L-1 shall be given 1st priority. In case of tie latest purchased vehicle will be given priority.

f. 24 hrs. requirements and deployment in O&M departments will be met first.

g. Normally all the requirement shall be fulfilled in first phase only immediately after rate fixation in tendering. However if any more vehicles is required latest model vehicle will be given priority.

h. The fixed rate shall be firm for 2 years and may be extended for another one year as per the discretion of NTPC at the same rate, terms & conditions.

i. Cost of diesel will be reimbursed at the prevailing rate, on the basis of 01(one) Liter per 12 Km run against production of documentary evidence.

j. EMD for each jeep shall be Rs.10,000.00. The party intending to Bid for more than one vehicle shall deposit EMD at Rs.10,000.00 per each Jeep.

k. The EMD will be forfeited if party is not deploying jeep after becoming L1 or after acceptance of final rate.

l. Model – Jan' 2012 (for PAPs – Model – Jan' 2010) onwards Jeep only to be deployed. Bidder may also buy new jeep and deploy within 15 days from date of confirmation of order (FAL); in such case, Bidder is to give undertaking that he will deploy vehicle within 15 days, complying with all statutory requirement and all other terms & conditions of jeep deployment.

m. Service Tax is payable extra as per applicability. The Bidder should obtain Service Tax Registration Certificate.

n. The vehicle may be deployed on 24 hrs. basis or 12 hrs. basis in any Deptt. / Location as per NTPC requirement at the discretion of NTPC, & Agency shall not have any claim / preference in this regard.

o. Maximum number of vehicle to be deployed by any agency shall be restricted to two (At least one no. for 12 hrs duty).

p. Fixed lump sum rate of deployment of vehicle shall be inclusive of fuel consumption for the movement of the vehicle from the premises of the vehicle deploying agencies to the deployment location at NTPC premises (i.e. place of reporting to E-I-C).

q. The vehicle shall report at working place of E-I-C. In case of Ash Dyke the vehicle shall report at the place as per E-I-C.

r. E-I-C shall ensure the certification of vehicle log book on day to day basis with detailed break up of running kilometer.

6.0 The Tendering shall be in Three - Envelope Bidding System: (All photocopies should be attested by the bidders himself) :

7.0 NTPC reserves the right to assess independently the capacity and capabilities of the bidders to carryout the work.

8.0 NTPC reserve the right to accept or reject late/delayed tenders and also to reject any or all tenders without assigning any reason thereof.

9.0 A complete set of bid documents may be obtained by any interested bidder on any working day, between 10.00 AM to 12.00 PM & 15.00 PM to 17.00 PM on submission of a written application alongwith Identity proof & Residence proof indicating that they will fulfil the QR of NIT and they will submit relevant documents sought at para 4.0 above along with Technical Bid which shall be determined during the bid evaluation.

10.0 The bidding documents may also be downloaded from http://www.ntpctender.com on registration cost of bidding documents shall be free and downloaded documents can be used for bidding purposes.

11.0 In case the registered bidders who have downloaded the bidding documents require an additional manual copy of the document then such bidders shall be required to obtain the manual copy of the bidding documents following the procedure detailed above.

SALIENT TECHNICAL FEATURES

NAME OF WORK “FIXATION OF RATES AND DEPLOYMENT OF DIESEL JEEP IN NTPC ”.

KSTPS is a coal based Super Thermal Power Station in Korba District of C.G. State. The Power Station has an ultimate capacity of 2600 MW (3x200 MW + 4X500MW).

The Power station is located about 50Km away from Champa Railway station of South East Central Railway (Mumbai – Nagpur – Bilaspur - Kolkatta). The power station site is also connected by road to Champa. The nearest commercial Airport is Raipur which is approx 220KM from the site.

01. The bidder must visit the site before quoting rates.

02. Cost of diesel will be reimbursed at the prevailing rate, on the basis of 01(one) Liter per 12 Km run against production of documentary evidence. Cost of other oil / lubricants etc. shall be borne by the contractor

03. The work will be executed as per Standard Specification & Terms of Conditions / GCOC of NTPC.

ADDITIONAL CONDITIONS FOR EMD

STANDARD CLAUSE REGARDING BID SECURITY / EARNEST MONEY DEPOSIT (EMD) (FOR ALL CIVIL WORKS PACKAGES AND O&M PACKAGES INVITED UNDER DOMESTIC COMPETITIVE BIDDING (DCB) BASIS)

NOTE: THESE CLAUSES SHALL SUPERCEDE ALL THE RELEVANT CLAUSES RELATING TO EMD & LOU MENTIONED ANY WHERE IN THE TENDER / BID DOCUMENTS.

1.0 Earnest Money Deposit

1.1 The Bidder shall furnish, as a part of its Bid an Earnest Money Deposit (EMD) amount as mentioned in tender cover letter in a separate envelope, super scribed on the top as under:

1.2 The EMD offered shall, at Bidders option, be in the form of a crossed Demand Draft/Pay Order/Bankers Cheque or an unconditional and irrevocable Bank Guarantee from any of the banks specified in the bidding documents. The format of Bid Guarantee towards Bid Security shall be in accordance with the form of bid security included in the bidding documents. The Bid Security shall remain valid for a period of forty five (45) days beyond the original Bid validity period or beyond any extension in the period of Bid validity subsequently requested.

1.3 Wherever Bids under Joint Venture route are permitted as per the Qualifying Requirements in the Bidding Documents, the EMD by the Joint Venture must be on behalf of all the partners of the Joint Venture.

1.4 The EMD shall be accompanied with a Letter of Undertaking on non-judicial paper of appropriate value in the proforma prescribed in the bidding documents. The EMD and Letter of Undertaking shall be furnished in separate sealed envelopes.

1.5 Any bid not accompanied by an acceptable EMD and/or Letter of Undertaking in accordance with aforesaid provisions shall be rejected by the Owner as being non responsive and returned to the Bidders without being opened.

1.6 The Bid Security of all the unsuccessful Bidders will be returned as promptly as possible, but not later than one (1) month after the expiration of the bid validity period.

1.7 The EMD of successful Bidder to whom the Contract is awarded will be returned after the receipt of Bank Guarantee towards Initial Security Deposit.

1.8 The EMD shall be forfeited in any of the following circumstances by the Owner without any notice or proof of damage to the Owner, etc:

a) If the Bidder withdraws or varies its Bid during the period of Bid validity,

b) If the Bidder does not accept the correction of its Bid Price pursuant Clause 8.0 of NTPC GCOC.

c) If the Bidder does not withdraw any deviation listed in Statement of Deviations at the cost of withdrawal indicated by him,

d) If the Bidder refuses to withdraw, without any cost to the Owner, any deviation not listed in Statement of Deviations but found elsewhere in the Bid, or

e) In the case of a successful Bidder, if the Bidder fails within the time limit specified in Bidding Documents to furnish the required Security Deposit in accordance with Clause 9.0 of NTPC GCOC.

1.9 In case the amount of Bid Security is less than or equal to Indian Rupees Fifty Thousand (Rs. 50,000) the instruments for submission of Bid Security shall be as mentioned in bid document / special conditions.

NOTE: EMD in the form as specified at Para-1.2 above are only acceptable other EMD instruments such as FDR, National Defence Certificate, Post Office Saving Certificate NSC & Power Bonds are not acceptable.

2.0 EMD is exempted for Registered Co-operative Societies of land oustees and PAPs.

SPECIAL CONDITIONS FOR THE CONTRACTS OF

HIRING OF (4 WHEELERS) VEHICLE


1.0 SCOPE/TYPE OF VEHICLE

1.1 The contractor will be required to supply vehicles having the required specification in the following type as indicated in Tender set / FAL / Award Letter.

2.0 PERIOD OF CONTRACT:

2.1 The contract shall be valid for a period mentioned in Tender/LOI/LOA.

2.2 However during the tenure of the contract if the company does not require the services of the vehicles, it shall terminate the contract by giving one month's notice.

2.3 Should performance of the contractor be found unsatisfactory, the contract should be terminated without any notice forthwith.

3.0 SUPPLY AND PLACEMENT:

3.1 Vehicle required for 24/12 Hrs basis daily. The Jeep may be deployed on Sundays /Holidays also as per requirement at the same rate.

3.2 Whenever any vehicles hired is to be withdrawn for any reasons, the contractor should ensure prior replacement of such vehicle before withdrawl. Replacement Jeep shall be got approved from the user before withdrawing the earlier vehicle.

3.3 Contractor should obtain the Fitness Certificate from R.T.O.'s for the whole duration of the contract period. Vehicle deployed should have taxi permit as per Commercial Tax norms of R.T.O. and should posses Commercial Insurance.

3.4 NTPC reserves the right to change of area of deployment during the contract period.

3.5 NTPC reserves the right to terminate the contract at anytime with one month prior notice.

3.6 Vehicle can be deployed at any site/area as per discretion of NTPC.

4.0 ACCIDENT:

4.1 Should the vehicle supplied on hire by the contractor to the company meet with an accident, while being utilized by the company, no claim on account of damages to the vehicles and to the persons traveling in such vehicles including the employee of the contractor (includes Driver/Cleaner of the vehicle) shall be maintainable on the company.

4.2 The contractor shall cover this risk adequately by obtaining comprehensive insurance policies and the company shall not bear any expenses on this account.

4.3 Should the vehicle supplied on hire by the contractor to the company by the contractor meet with an accident due to reasons attributable to the contractor or his employees and cause damages to the persons/property of the company, the contractor shall be liable to make good such losses in the manner as prescribed by the company.

5.0 PAYMENT:

5.1 All payments due to the contractor will be payable on completion of a month in the subsequent month after receiving proper bills from the contractor in the prescribed proforma along with supporting documents as may be needed from time to time, to be certified by officer-in-charge.

5.2 Such payment will be based on the documentary evidence of utilization of the vehicles which will be based on the daily Log books/Trip sheets, a copy of which are to be submitted by the contractor along with his bills. Payment due, if any will be based on verification of such documents.

5.3 Cost of diesel will be reimbursed at the prevailing rate, on the basis of 01(one) Liter per 12 Km run against production of documentary evidence. Cost of oil and lubricant will have to be borne by contractor.

5.4 The cost of fuel:- for this purpose as well as for the per km rate will be the actual rates prevailing at such times of utilization. Normally the rates prevalent at the nearest outside Petrol Pump will be taken as the basis. However, if the diesel has been purchased at an outstation beyond 200KMS.the rate will be on the actual rates paid by the contractor which will be decided on verification of cash bills produced by the contractor in support of such claims.

5.5 No advance shall be payable to the contractor. However, on bills accepted for payment, the contractor shall secure 75% of the same as advance subject to availability of funds.

6.0 COMPENSATION FOR NON-AVAILABILITY:-

6.1 If the vehicle is not made available un-authorized i.e. absent from duties, then on such circumstances cash compensation will be deducted @ 50% of the rate applicable from the bill of contractor. No payment for the day will be made.

6.2 In case the user has no objection to the specific request made in advance by the contractor for not making the jeep available for a specific duration on a particular day/days then no penalty shall be levied for such authorized period of non-availability of the Jeep. However, no payment shall be made for such period certified by the user.

7.0 DEDUCTION FOR OTHER REASONS:

Should the company be held responsible for any of the lapses of the contractor or his employees at any stage during the contract, and should the company be made liable to incur such expenditure on this account, the company shall deduct such amounts together with overhead charges calculated at 20% from an amount payable to the contractor, including the security deposits.

8.0 INSPECTION OF SITE:

The contractor shall inspect and examine the site and the surroundings and shall satisfy himself before submitting the tender as to the nature of the site, access to site accommodation needs and obtain all necessary information as to risks, contingencies and other circumstance which may influence or effect his tender. No extra charges subsequent to any misunderstanding or other wise shall be allowed. It will be taken that the contractor is familiarized himself fully with the above irrespective of the fact whether he has done so or not and no claim on this account shall be maintained at a later date.

9.0 SUB-CONTRACT:

The contractor shall not sub-let of the contract.

10.0 ARBITRATION:

10.1 Except otherwise provided for in the contract, all questions and disputes relating to the specifications, instructions, orders or the executions or failure to execute the same, whether arising during the work or on completion shall be referred to the sole arbitration of the General Manager of KSTPS.

10.2 The award of the arbitration shall be final, conclusive and binding on all the parties of this contract.

11.0 INCOME TAX:

Income tax as per provision of Income tax Act. from gross value of contract shall be deducted at source unless the contractor is exempted by Income Tax authorities.

12. GENERAL CONDITIONS:

12.1 Jeep shall be utilized by KORBA STPS for works at various offices, at various sites and at various time as per requirements.

12.2 Vehicle can be utilized up to 500KM in a day for Corporation work up to maximum radius of 500Km.form the place of deployment of the Jeep. However, the vehicle is mainly required for work in KORBA STPS Plant areas/Township area/sites.

12.3 Driver shall be provided by the owner with a minimum Rs.500/- as Cash with him for minor maintenance work/allied emergencies.

12.4 The servicing and repairing shall be carried out by the owner immediately on under intimation to NTPC for this purpose owner will be allowed 24 hrs. or part there of (for 24 hours deployment vehicles only) in a month as paid of day. More than this will be treated as absent from duties and cash compensation will be deducted at normal rate for absent period as a special case.

12.5 The payment shall be made on monthly basis as per actual working of the Jeep.

12.6 Jeep shall be mostly used for Field work.

12.7 Any vehicle provided by the contractor on hire to the Company should be made available at the place and time as specified by the authorized officers of the Company in time.

12.8 Such requirement could be made at any time of the day (including night) and on any day (including Sunday & Holidays).

13.0 DRIVERS AND CLEANERS:

13.1 The contractor shall ensure that the vehicle hired to the company are driven only by himself by or any other competent and experienced driver possessing valid and current driving License.

13.2 The licenses of the drivers employed on the vehicles will be verified by the company before they are put on work.

13.3 Originals of driving licenses, registration books ownership details and all other relevant documents connected with the vehicles hired and drivers employed shall be produced to the company at such places and times as may be needed for verification and one copy each of such document shall be submitted.

13.4 The contractor or his employees shall not at any time cause or permit any nuisance or damage to properties on the site and township and or do anything which shall cause unnecessary disturbance or inconvenience to the owners, tenants or residents and the public in general.

13.5 In case the vehicle is run 24 hrs. Basis contractor should deployed at least 2(Two) drivers alternatively for deployment of Jeep on 24 hrs. Basis.

14.0 WAGES AND WORKMEN'S COMPENSATION:

14.1 The persons deployed by the contractor in the vehicles shall be paid wages by the contractor timely and in full as per the relevant status. Such wages shall not be less than the minimum rates of wages notified by Central Government minimum wages rules and subsequent notification issued from time to time.

14.2 The contractor shall obtain workmen’s compensation insurance for all the persons employed by him and such insurance shall be kept current and valid during the period of contract. Copies of such insurance should be sent to the company as and when required.

14.3 The contractor will indemnify the company from all claims for injuries caused to any persons whether a workmen or not while in or upon the works or the site of the same and the company shall not be bound to defend any claim brought under workmen's compensation act or any of its subsequent amendments unless the contractor makes a written request for the same and first deposit with the company, a sum which the company might incur by reason of defending and for specifying any such claim.

14.4 Any claims that may arise out of the employees of the contractor if met by the company, the company shall have the right to recover such amounts from the contractor and the liability in full with an additional charge of 20% overheads.

14.5 The company shall further be entitled to recover the amount paid by way of compensation under the aforesaid act or under any other law by deducting the sum from the security deposit of the contractor or from any other sum due to him under this contract or any other kind whatsoever.

14.6 The contractor shall apply all the provisions of payment of wages act, 1936, minimum wages act, workmen compensation act, 1923. Industrial disputes Act.1970, Motor Transport workers act and other relevant statutes relating thereto made from time to time.

15.0 OWNERSHIP PERMITS AND INSURANCE:

15.1 Vehicle hired to the company by the contractor shall be owned by the contractor and shall not be sold or mortgaged during the currency of the contract without obtaining written permission from the company.

15.2 All vehicles supplied to the company on hire should possess valid and current permits/ licenses as may be required by the respective RTOs for the whole duration of the contract, along with Commercial Taxes.

15.2.1 All Vehicles should have Taxi permits, Complying all Commercial norms of R.T.O. Commercial Tax including cost of Taking permit to run as taxi shall be on Contractors on Account.

15.3 No amount is payable by the company for obtaining such permits/commercial/Commercial Taxes/Commercial Insurance etc.15.4 Failing to maintain the currency of such permits/Licenses during the period of contact will lead to immediate termination of the contractor without offering any notice.

15.5 A Photostat copy of such permits/licenses shall be submitted to the authorised officer of the company before commencement of work.

15.6 The contractor shall ensure that the vehicles supplied on hire to the company are comprehensively insured and maintained current and valid during the total period of contract.

15.7 The cost of such insurance shall not be borne by the company.

15.8 A Photostat copy of such insurance policies of the vehicle hired by the company shall be made available to the company free of cost by the contractor before commencement of work. If any renewals or amendments to those insurance policies are carried out during the currency of the contract the contractor shall made available a copy of such change immediately to the company.

15.9 The company shall not be liable to provide either accommodation or garage facilities to the contractor or his employees.

16.0 TOLLS AND PARKING CHARGES:

16.1 Toll charge at bridges, parking charges in Airport/Railway stations wherever become payable for the Journey undertaken by the vehicles for the company, such charges shall be initially paid by the contractor.

16.2 However, such expenditure at 16.1 will be reimbursed provided the contractor claims reimbursement of the same by producing the original receipts, such claims shall be made before completion of the following month.

17.0 The persons deployed by the contractor in the vehicles shall be paid wages by the contractor timely and in full as per the relevant status. Such wages shall not be less than the minimum rates of wages notified by Central Government minimum wages rules and subsequent notification issued from time to time.

18.0 RETENTION CHARGE FOR OUTSTATION DUTIES:-

For outstation duties to places like Bilaspur or Raipur, NTPC shall pay extra charges beyond 100 km one way with or without night halt at the prevailing rate. In such cases no night halt charges shall be paid extra.

19.0 In Case Vehicle is attached to State/Central Govt. duties payment shall be made extra on documentary evidence and certification of Engr-in-Charge.

SAFETY CLAUSES IN O&M CONTRACTS

(These clauses are additional to what given in GCOC / O&M special conditions)


1. OBJECTIVES

1.1 the purpose of this document is to provide broad guidelines to be followed on the safety of NTPC contractors’ employees. It should be read and understood clearly that it is the contractor’s responsibility to ensure and comply with all safety requirements.

1.2 Nothing stated or implied in this safety conditions shall relieve the contractor from any obligation or responsibility placed upon him by the conditions the contract or under the statutes.

2. GENERAL CONDITIONS

2.1 The Contractor on his own interest shall comply with safety regulations and ensure that the employees deployed by him under this contract wear all personal protective and safety equipments and adopt safe working practices.

2.2 It shall be the duty of all persons concerned with the operation of and maintenance work on all the systems and apparatus to make themselves thoroughly conversant with the Statutory Requirements and Safety Rules governing any work they may have to undertake on these systems and apparatus.

3. RESPONSIBILITIES

3.1 It shall be the responsibility of all contractors and their employees, agents/ authorized representatives to comply with :-

a) All relevant statutory requirements, Acts of Parliament, Regulations, orders and approved Codes of Practice.

b) The NTPC Safety Rules (Electrical & Mechanical) save any Regional Variations to such rules currently in force.

3.2 It shall be the responsibility of the Contractor and their employees to adhere to the systems of Permit-to- Work under the NTPC Safety Rules (Electrical & Mechanical).

4. CONTRACT MANAGEMENT

4.1 For every contract at NTPC (KSTPS) Power Station , work site , an engineer responsible for contract management hereinafter called “Engineer-In-Charge “ nominated shall be appointed by the NTPC and will discuss with the Contractor’ representative on safety measures applicable to the work and application of all the appropriate NTPC Safety Rules.

4.2 The Engineer-In-Charge responsible for contract management or safety officer or any person authorized under the NTPC Safety Rules, will have authority to stop any work and/ or ask the delinquent unsafe employee of the contractor to leave NTPC premises -+including fore feature of Gate pass/ permanent removal of such contractor’s personnel, if, in his opinion, this is necessary in the interests of safety. NTPC will not accept any liability whatsoever for any loss incurred by the contractor due to non compliance of safety regulations/ practices.

5. WORK ENVIRONMENT

5.1 Contractors are required to confine the storage of plant equipment and materials and the erection of site to sheds to areas company allotted. The Engineer-In-Charge shall also stipulate the limits within which contractor’s employees are allowed access.

5.2 Contractors shall keep their work site clean and tidy and clear of unnecessary obstructions. All floors and walkways must be kept clear of materials and free from any substance likely to cause anyone to slip. Tools and equipment must not be left lying around. Nails shall be immediately removed from all loose timber. All materials, equipment and tools shall be neatly stored.

5.3 Contractors shall be responsible for arranging for the regular disposal of the waste and rubbish generated during the course of their work. Whilst awaiting collection, this must be held at disposal point designated by the Engineer-In-Charge who will also direct where scrap material and any waste oil may be disposed off/ handed over. Under no circumstances waste oil may be allowed to enter into any drain or trench and or cause slippery floor due to spillage.

5.4 The contractor shall ensure effective supervision to carryout the work in accordance with the provisions of Factories Act 1948 and any other statutory provisions applicable to them, and NTPC Safety Rules, NTPC Elect. and Mechanical Safety Rules.

5.4.1 Personal Protective Equipments as required by Factories Act shall be provided by the Contractor at his own cost. In case the Factories Act does not specifically provide about these personal protective equipments, the personal protective equipments prescribed by NTPC Safety officer/ Chief Safety officer, shall be provided by the contractor. The quality of the personal protective equipments shall be as per relevant Indian standards. It shall be responsibility of the contractor to ensure that all his employees use these equipments without fail.

5.4.2 The contractor shall ensure that the equipments/ electrical installations, system facilities provided by him are as required under various statutes. He shall also ensure periodical testing/ examination of the equipments wherever required, in accordance with the provision of the Factories Act or any other prescribed statutes and submit a copy of such test certificate to Engineer-In-Charge.

5.5 Crawling ladders or crawling boards shall be used when working on or from fragile roofs or fragile materials. In such situations, warning notices shall be displayed where the fragile material is situated.

5.6 Barriers with identified danger marks shall be erected around any holes or opening which may become a source of danger. Warning notices shall be posted by day and red lamps displayed during hours of darkness. If it is necessary to remove any trench slabs gulley gratings, or mesh or other type floor sections, permission must be obtained from the Engineer-In-Charge and such slabs gratings or sections must be replaced properly and as soon as possible. Should any slabs be broken, then immediate steps shall be taken to prevent danger pending their replacement.

5.6.1 The contractor shall not remove any part of equipment (like guards etc.) or gangways (like fencing base etc.) or other systems without the permission of Engineer-In-Charge. Where any guards are removed for repair it will be provided back to its place, before any operations or use of the equipment. The contractor shall not handover/ allows operating these equipments till the guards are provided at its place.

5.6.2 In case any opening in gangway/ access etc., is caused due to removing any part of base for lifting of material, either the opening shall be suitably fenced or suitably covered to prevent fall of any person in such openings. Otherwise temporary fencing shall be provided whenever required.

5.7 The contractor shall not disturb/ remove any barriers, screens or notices placed in position by the NTPC. Persons must not on any account pass through or jump over any barrier.

5.8 No substation boundary fences either temporary or permanent shall be disturbed without written permission of the Engineer-In-Charge.

5.9 Nobody shall ride on a hoist unless it has been designed to carry passengers and is fitted with inter lock gates and safety devices required by the Factories Act 1948 the construction (Lifting Operations) Regulations or other special regulations.

5.10 Every contractor’s employee shall be under proper supervision when working at NTPC premises.

5.10.1 Wherever prescribed the contractor shall not undertake any work till the permit is obtained by him from Engineer-In-Charge in accordance with NTPC Rules.

5.10.2 The employees employed by the contractor should be suitably skilled/ competent to the satisfaction of Engineer-In-Charge. Engineer-In-Charge shall have absolute discretion to remove any employee of the contractor and his decision shall be final. Contractor shall employ sufficient number of supervisors to ensure supervision at all places of his work as specified in General Conditions of Contract.

5.10.3 The contractor shall arrange to provide safety training to all his employees,. Whenever advised by NTPC, the contractor shall send his employees for safety training and for such day the employee shall be paid average daily salary by the contractor.

5.10.4 Contractor shall bring inside plant premises only such vehicles having authorized gate pass issued by NTPC and shall be driven only by an authorized license holder.

5.10.5 Such vehicles shall be parked only at the allotted parking place and shall not be parked in such a way that may cause inconvenience to other road users or people working around.

5.10.6 Contractor and his employees shall not enter/ roam around in places other than their authorized work place.

5.10.7 Wherever contractor employees have to work on or around electrical live lines/ parts like EOT Crane Bus Bar, Electrical panels etc., they shall obtain a valid permit to work from NTPC authorities before entering to that area.

5.10.8 Contractor shall not allow any unidentified stray objects at his work place/ stores or site sheds. If any such material is found it shall be promptly brought to the knowledge of Engineer-In-Charge safety personnel / CISF.

6. ACCIDENT REPORTING

6.1 It is statutory for the contractor to enter details of accidents occurred, if any, at the place work in the NTPC’s Accident Register. The Engineer-In-Charge shall be informed telephonically or in person immediately on occurrence of such event.

6.2 Whenever asked by NTPC/ statutory authority, the Contractor shall send his employees to depose in any enquiry arising out of any injury/ fatality / loss etc., without any reservation.

6.3 In care of any injury, the Contractor shall send the injured person to NTPC plant Hospital/ Dispensary / First Aid Centre where the injured person shall be given the first aid treatment and the quantum of permanent disablement / temporary disablement shall be assessed to ensure payment for compensation to be paid by the Contractor to the victim.

6.4 In Case the subsequent treatment is given at other than NTPC Hospitals, the Contractor shall submit hospital(s) full information about the treatment of injured persons including his address etc., till the injured person is fully fit to resume his normal duty and certified by any Doctor of Government / Semi Government Hospital.

6.5 The Contractor shall report the serious injury/ fatality of his worker or others working in his vicinity immediately (positively within 2 hours of occurrence) to the local Police Station, District Magistrate, Safety officer in charge and Engineer-In-Charge . In case of minor injury he shall report his injury to Safety officer in charge and Engineer-In-Charge immediately after referring the injured person to NTPC Plant Hospital/ Dispensary/ First Aid Centre.

7. WORKMEN COMPENSATION

7.1 In case of work injuries due to accidents or occupational diseases, Contractor shall be purely responsible for payment of compensation or any other benefits/ liabilities under Compensation Act or any other statutes.

8. LIABILITY CLAUSE

8.1 If the contractor fails to fulfill any of the conditions/ safety procedures/ requirements as prescribed herein above relating to safety, NTPC shall terminate the agency or any other action as may deem fit in the circumstance shall be taken. The above action is subject to the following:-

a). The Contractor shall indemnify NTPC for the damage caused to the property of NTPC for non-compliance of safety procedures mentioned herein above.

b) The contractor shall indemnify NTPC for any loss occurred/ to be occurred due to any accident which may result into loss of human life or temporary/ permanent disablement.

c) The contractor shall indemnify NTPC for any penalty imposed by any statutory authorities or Court of law in connection with the accident took place as stated above.

9. CONTRACTORS QUERIES

9.1 All queries shall be directed to the Engineer-In-Charge of the contract.

Additional Safety Clauses for Operation & Maintenance Contracts

(ISSUED BY CORPORATE SAFETY DEPARTMENT)


I. General

1. The Contractors shall comply the provisions of Factories Act 1948, any other statutory provisions applicable to them to ensure occupational health and safety, NTPC Electrical & Mechanical Safety Rules and any other Rules made by NTPC relating to Operation & Maintenance of Plants. The contractor shall make arrangements at all his work places for ensuring safety and absence of risks to health of the workers.

2. The contractor shall ensure that the equipments / electrical installation system / facilities are provided and maintained by him as required under various statutes. He shall also ensure testing / examination of the equipments wherever required, in accordance with the provisions of the Factories Act or any other prescribed statutes. The record of such inspection / testing and examination shall be kept at the site and shown to NTPC Engineer Incharge / Safety Incharge on demand.

3. The contractor shall ensure that all floors steps, stairs, passages and gangways are to be properly maintained and shall be kept free from obstructions and substances likely to cause persons to slip and fall.

4. The contractor shall not remove any part of equipments (like guards etc.) or gangways (like fencing, base etc.) or other systems with out the permission of the Engineer Incharge. Wherever any guards / other parts of the system are removed for repair, it will be provided back to its place, before any operation or use of the equipment. The Contractor shall not hand-over / allow operating these equipments till the guards are provided at its place.

5. In case any opening in gangway access etc. is caused due to removing any part of base for lifting of material or otherwise, either the opening shall be suitably fenced or suitably covered to prevent faill of any person in such openings in consultation with Engineer Incharge. Temporary fencing shall also be provided whenever required along with appropriate caution boards lighting etc.

6. The employees employed by the contractor should be skilled / competent in accordance with the job requirement to the satisfaction of Engineer Incharge, Engineer Incharge shall have a right to remove any employee of the contractor whom he fells to be incompetent. The contractor shall employ sufficient number of supervisors to ensure

Supervision at all places of his work at all the times.

7. No person should be allowed to carry, lift or move any load so heavy which may likely to cause his injury as prescribed under concerned state factories rules.

II. Working at Heights.

1. All working platforms, ways and other places of O&M work area shall be free from accumulations of any material causing obstructions and tripping.

2. Wherever workers are exposed to the hazard of falling into water the contractor shall provide adequate equipment for saving the employees from drowning and rescuing from such hazards. The contractor shall provide boat or launch equipped with sufficient number of life buoys, life jackets etc. manned with trained personnel at the site of such work.

3. Every opening at elevation from ground level though which a worker, material, equipment etc. may fall at O&M work area shall be covered and/or guarded suitably by the contractor to prevent such falls.

4. Wherever the workers are exposed to the hazards of falling from height, the contractor shall provide full harness safety belts fitted with fall arresting systems to all the employees working at higher elevations and lifeline of 8 mm diameter wire rope with turn buckles for anchoring the safety belts while working or moving at higher elevations Safety nets shall also be provided for saving them from fall from heights and such equipment should be in accordance with BIS standards.

5. Wherever there is a possibility of falling of any material, equipment or workers while working at heights a suitable and adequate safety net should be provided. The safety net should be in accordance with BIS Standards.

6. The contractor shall provide proper access like ladders etc. where the workers are required to reach higher elevations and ensure the workers use them as an access for higher elevations where a permanent access is not available. The workers shall be provided with safety belts fitted with suitable fall arresting system (Fall arrestors) for climbing/getting down through ladders to prevent fall from height.

III. Openings.

The contractor shall ensure that vessel, sump, tank, pit or opening in ground or in a floor which by reason of its depth, situation, construction or contains or may be a source of danger at his workplace shall be either securely covered or fenced and necessary measures for protection against falling materials/objects or workers from such platform are taken by providing suitable safety nets, safety belts or other similar means.

IV. Fencing of Machinery.

The contractor shall not allow any worker to examine any part of the machinery or to carry out the lubrication or other adjusting operation while the machinery is in motion. The workers working near the machinery in motion shall be provided with tight fitting clothes as required under State Factories Rules.

V. Scaffoldings and Work platforms.

The contractor shall take all precautions to prevent any accidental collapse of scaffolding or working platforms or fall of persons from scaffolding or working platforms. The contractor shall ensure that scaffolding erection and repairs are done under the expert supervision. The scaffolding shall meet the required strength and other requirements for the purpose for which the scaffolding / work platform is erected. The material used for scaffold / work platform should conform to the BIS standards.

VI. Confined Space.

1. No person should be allowed to enter any chamber, tank, wet, pit, pipe, flue or other confined space at his work area in which any gas, fume, vapour or dust is likely to be present to such an extent as to involve risk to persons unless it is provided with a manhole of the required size or other effective means of egress. The contractor shall take practicable measures to remove any gas, fume, vapour or dust to bring it its limit within the permissible limits and to prevent any risk to the workers.

2. No portable electric light or any other electrical appliances of voltage exceeding 24 volts shall be permitted for use inside any chamber / tank, wet, pit, pipe, flue or other confined space unless adequate safety devices are provided where the inflammable gases, fumes or dust is likely to be present.

VII. Handling of Hazardous Chemicals and hazardous waste.

1. The contractor shall provide suitable personal protective equipments to the workers who are handling the hazardous and corrosive substances including alkalis and acids.

2. As a precautionary measure the contractor should keep the bottles filled with distilled water in cupboard / Boxes near work place for emergency eye wash by worker exposed to such hazardous chemicals.

VIII. Right to Stop Work.

1. The Engineer I/c shall have the right at his sole discretion to stop the work if in his opinion the work is being carried out in such a way that it may cause accidents and endanger the safety of the persons and / or property and or equipments. In such cases the contractor shall be informed in writing about the nature of hazards and possible injury / Accident and he shall comply to remove shortcomings promptly.

2. The contractor shall not be entitled for any damages compensation for stoppage of work due to safety reasons and the period of such stoppage of work shall not be taken as an extension of time for Completion of the Facilities and will not be the ground for waiver of levy of liquidated damages.

IX. Overhead protection.

1. The contractor shall ensure that any area exposed to risk of falling materials, articles or objects is roped off or cordoned off or otherwise suitably guarded from inadvertent entry of any person.

2. Wherever there is a possibility of falling of any material, equipment or construction workers while working at heights, a suitable and adequate safety net should be provided. The safety net should be in accordance with BIS Standards.

X. Eye Protection.

The Contractor shall provide suitable personal protective equipment to his workmen depending upon the nature of hazards and ensure their usage by the workers engaged in operations like welding, cutting, chipping, grinding or similar operations which may cause injuries to his eyes.

XI. Electrical Hazards.

1. The contractor should ensure that all electrical installations/equipments used in O&M work area comply with the requirements of latest electricity acts/rules.

2. The contractor shall take all adequate measures to prevent any worker from coming into physical contact with any electrical equipment or apparatus, machines or live electrical circuits which may cause electrical hazards during the construction work. The contractor shall provide the sufficient ELCBs/RCCBs for all the portable equipments, electrical switchboards, distribution panels etc. to prevent electrical shocks to the workers.

3. The contractor should ensure use of single/double insulated/Plastic body hand tools or low voltage i.e. 110 volts hand tools.

4. Wherever NTPC Electrical & Mechanical Safety Rules prescribe, the contractor shall not undertake any work till the permit is obtained for the specific work in accordance with NTPC Rules.

XII. Lifting tools and tackles.

The contractor shall use the lifting appliances, tools & tackles including cranes etc. lifting gear including fixed or movable and any plant or gear, hoists, Pressure Plant and equipment etc. are in good condition and examined by competent person and certified as per statutory requirements.

XIII. Medical examination.

1. The contractor shall get the medical examination conducted ofall his employees including his sub-contractor employees working in hazardous areas once before the employment and thereafter once in every year by a qualified medical practitioner as per the Factories Act-1948 and concerned State Factories Rules. The necessary registers and records relating to the medical examination of all the employees should be maintained and shown to NTPC Engineer Incharge Safety Incharge on demand.

2. If the contractor fails to get the medical examination conducted as mentioned above NTPC will have the right to get the same conducted by NTPC Medical Officer with intimation to the contractor and deduct the cost and overhead charges.

XIV. Safety organization.

The major O&M contractors who are depoying number of agencies under his control should appoint at least one qualified safety officer. The other terms with respective to appointment of number of Safety Officers, qualifications, experience duties and responsibilities etc. shall be in accordance to the concerned States Factories Rules. The other contractors site Incharge who is directly supervising the job should undergo minimum two days Safety training at any reputed institute or at NTPC training center before start of the work and obtain the certificate. A copy of the certificate has to submit to Engineer Incharge of NTPC.

XV. Reporting of accidents

1. In case of any injury, the contractor shall send the injured person to NTPC Plant Hospital Dispensary First Aid Centre, where the injured shall be given the first aid treatment and the quantum of permanent disablement temporary disablement shall be assessed to ensure payment for compensation to be paid by the contractor to the victim.

2. In case the subsequent treatment is given in other than NTPC Hospitals, the contractor shall submit full information about the treatment of injured persons including his address etc. till the injured person is certified fit by any Govt. / NTPC doctor. He shall submit such record to NTPC Safety Deptt. within 15 days of certified fit by Doctor as above.

3. The contractor shall report immediately about the serious injury / fatality in his work area to the local police station, Distt. Magistrate, Safety Officer Icharge and Engineer Incharge. Within 2 hrs. of occurrence he shall submit full details of accident in writing to Safety Officer Incharge and Enginner Inchare on the prescribed format. In case of near miss accidents / minor injury, he shall report the same to Safety Officer Incharge and Engineer Incharge immediately after referring the injured to NTPC Plant Hospital / Dispensary / First Aid Centre.

4. Whenever asked by NTPC, the contractor shall send his employees to depose in any enquiry arising out of any injury / fatality / loss etc. without any reservation.

XVI. Personnel Protective equipments.

1. The contractor shall provide safety helmets to all his employees including contractor Labour of his sub contractor to prevent a danger of falling object. Whenever any worker is engaged on a work at a place from which he is liable to fall more two meters shall be provided with Safety belt equipped with lifelines, which are secured to a fixed struction. A competent person toensure that no belt and lifelines at frequent interval.

2. Where the workers are exposed more than to the noise levels specified in the concerned State Factories Rules be provided with suitable ear plugs / ear muffs so as to reduce the exposure below high noise level.

3. Personal Protective Equipments as prescribed in the Factories Act and / or State Factories Rules, the Contractor shall provide to the workers. In case the Factories Act / State Factories Rules do not specify the personal protective equipments for the concerned work, the personal protective equipments prescribed by NTPC Engineer In charge shall be provided by the Contractor. The quality of the personal protective equipments shall be as prescribed in concerning Indian Standards. In case, the Indian standards do not exist or particular personal protective equipment, the approval of quality shall be obtained from Engineer Incharge / Head of Safety. It will be the responsibility of Contractor to ensure that all his employees use these equipments without fail.

4. In case NTPC officials find that the employees of contractors working in NTPC without use of appropriate safety equipments (personal protective equipments) NTPC shall have a right to issue the equipment to the workers with intimation to the contractor and deduct the cost and overhead charges as mentioned in the terms of the contract.

5. NTPC may provide special personnel protective equipments like fail arrestors, Safety Nets etc. on chargeable / non chargeable basis, subject to availability to the petty contractors on his request to Engineer I/c in advance indicating total no. of items quantity and type of equipments required, provided this condition is specifically included in the contract conditions.

XVII. Training.

1. The contractor shall arrange to provide safety training to all his employees. Whenever asked by NTPC also, the Contractor shall send his employees for safety training and for such day the contractor shall pay the employee average daily salary.

2. The contractor shall provide training on use of fire extinguishers and first aid to all his employees and records thereof shall be submitted to Engineer Incharge and Head of Safety of NTPC. The training may be provided independently or may be nominated to the programmes being organized by NTPC from time to time.

XVIII. Penalties.

1. If the contractor fails in providing safer working environment as prescribed in General Conditions of Contract relating to safety and health or continue the work even after being instructed to stop the work by Engineer Incharge, the Contractor shall be panalize @Rs.5,000/- per day or part thereof till the instructions are complied with and so certified by the Engineer Incharge. However, in case of accident causing major injury or fatal, the provisions contained below shall also apply in addition to the penalties mentioned in this clause.

2. If the contractor does not take all safety precautions and / or fails to comply with the Safety Rules as prescribed by the Employer or under the applicable law for the safety of the plant and equipment and for the safety of personnel and the contractor does not prevent hazardous conditions which cause injury to this own employees or employees of other contractors, or the Employer’s employees or any other person who are at the Site or adjacent thereto, the Contractor shall be responsible for payment of penalty to NTPC as per the following schedule.

a) For fatal accident / injury causing death

Penalty @ 10% of the contract value Rs.5 lakh whichever is less for each fatal accident / injury causing death.

b) Major injury or accident causing 25% or more permanent disablement to workmen

Penalty @ 2.5% of contract value or Rs.1 lakh whichever is less for each disablement injury.

3. Permanent disablement shall have the same meaning as indicated in Workmen’s Compensation Act, 1923. The penalty mentioned above shall be in addition to the compensation payable to the workmen / employees under the relevant provisions of the Workmen’s Compensation Act and Rules framed there under or any other applicable laws as applicable from time to time.

4. If any contractor worker found working without using the safety equipment like safety helmet, safety shoes, safety belts etc. or without anchoring the safety belts while working at height the Engineer I/c / Safety Officer of NTPC shall have the right to panelize the contractor for Rs.200/- per person per day and such worker shall be sent out of the workplace immediately and shall not be allowed to work on that day Engineer I/c / Safety Officer of NTPC will also issue a notice in this regard to the contractor.

EMS CONDITIONS FOR ENVIRONMENTAL IMPROVEMENT.

The following points are to be ensured by the contractor for ensuring environmental improvement:

01/ Contractor shall ensure that environmental related awareness training has been given to his employees at the time of start of new contract.

02/ During the activities of maintenance/overhauling/cleaning, waste generated is to be disposed as follows:

A) Before start of work, contractor should ensure availability of following in the place of work.

· Drum/Jerry cane/trays for waste lubricating oil.

· Drum/Jerry cane/trays for waste liquid cleaning agent.

· Identified container for waste jute.

· Identified container for waste gasket/Asbestos/rubber.

· Identified container/sacks for keeping waste insulations wool.

· Sufficient No. of trays for keeping equipment parts for maintenance.

· Funnels, hoses and strainers in sufficient quantity for transfer of oil.

B) During the maintenance activity, waste generated shall be kept in identified storage

area.

C) Waste insulations wool shall be kept in sacks/identified drum.

D) Metallic scrap should be kept at identified place as per instruction of Engineer in charge. It is to be ensured by the contractor that at the time of disposal of the waste materials, proper segregation is done by his workers to avoid mixing of material.

E) Sufficient care shall be taken by the contractor/his personnel to avoid any

spillage leakage of oil, spillage of grease during replacement maintenance, and transportation. Waste shall be kept in drums and shall be shifted to identified area. In case of spillage of oil, the oil is to be cleaned and waste jute disposed as mentioned above.

All the above waste material is to be shifted to a place for further disposal. It is to be ensured by the contractor that spillage should not take place due to overfilling during transportation.

03/ Proper safety equipments are to be provided to the workers by the contractor. Safety

helmets and shoe is must for all workers. Gloves, goggles, dust mask, ear muffs etc.

are to be provided by the contractor as per job requirements.

04/ Prompt corrective action shall be taken by the contractor for any of his activities,

which may lead to environmental impact.

SCOPE OF WORK & SPECIAL TERMS AND CONDITIONS

1.0 SCOPE / TYPE OF VEHICLE:

1.1The Contractor will be required to deploy vehicles with the following specifications:

2.0 PERIOD OF CONTRACT:

2.1 The Contract shall be valid for a period of two years i.e. 731 days from the date of commencement of work.

2.2 During the tenure of the contract if the company does not require the services of the vehicle, it can terminate the contract by giving one month’s notice.

2.3 Should performance of the contractor be found unsatisfactory, the contract shall be terminated without any notice forthwith.

2.4 However, the contract may be extended up to a period of one year at the same rates, terms & conditions, if the party agrees subject to recommendation of the Engineer-in-charge and validity of all required documents.

3.0 FORE-CLOSURE OF CONTRACT:

3.1 In the event of NTPC deciding that the services of the Jeeps are not required, NTPC may fore-close the contract by serving a one month's notice for the same by the Engineer-In-Charge to the Contractor. Upon such fore-closure, the Contractor shall be entitled for only the on account payment due to him for the work actually performed and as certified by the Engineer-In-Charge. No claim for loss of profit, etc… whatsoever shall be entertained subsequent to such fore-closure of the contract.

4.0 CANCELLATION OF CONTRACT:

4.1 If it is found that the performance of the Contractor is not satisfactory/non deployment of vehicle for more than 7 days and the Contractor does not take any remedial and corrective actions for improving the performance, even after serving of a notice of default, NTPC shall reserves the right to cancel the Contract by serving a 7 days final notice for the same. Upon such cancellation, the entire Earnest Money Deposit/ Security Deposit of the Contractor, lying with NTPC shall stand forfeited. NTPC shall also reserve the right to carry out the unfinished work at the risk and cost of the Contractor. Decision as taken by the Engineer-In-Charge as regards cancellation, etc. shall be final and binding on the Contractor and no further correspondences regards revocation of cancellation, waiver of forfeiture, etc., subsequent to the cancellation shall be entertained

5.0 SUPPLY AND PLACEMENT:

5.1 Vehicle will be engaged for 12 Hrs. daily and shall be supplied for all the days of contract period including Sundays and Holidays and to be reported to Engineer-in-charge at 8.00 AM sharply (12 hrs. duty).

5.2 Cost of diesel will be reimbursed at the prevailing rate, on the basis of 01(one)Liter per 12 Km run against production of documentary evidence like cash receipt/invoice in original from nearest outlet petrol pump and certification by EIC. The cost of lubricants, oil shall be borne by the agency as per scope of work and condition of tender document/GCOC of NTPC.

5.3. Whenever vehicle hired is to be withdrawn for any reasons, the contractor should ensure prior replacement of such vehicle before withdrawal. Substitute vehicle shall be got approved from the user before withdrawing the earlier vehicle.

5.4 If the vehicle is not made available or un-authorized absent from duty, then a penalty of 50% of the hire charges for the period of absence will be levied and no payment for the period of absence will be made.

5.5. Contractor should obtain the Fitness Certificate from R.T.O. for the whole duration of the contract period and insurance to be obtained as per rules. He shall also pay all taxes as per the prevailing rules and regulations.

5.6. Drivers to be deployed by the contractor shall possess valid driving license.

5.7. Vehicle can be deployed at any site / area as per discretion of NTPC.

6.0 OVERTIME:

6.1 Over time shall be payable as per rate Rs.33/per hour beyand 12hrs. deployment.

7.0 INCOME TAX:

7.1 Income tax as per provision of Income tax Act from gross value of contract shall be deducted at source unless the contractor is exempted by Income Tax authorities.

7.2The Income tax rate prevailing at the beginning of the Contract will be taken as a reference rate. However, during the course of contract period, if there is any enhancement from reference rate, the differential amount will be reimbursed to the Contractor.

8.0 ACCIDENT:

8.1 Should the vehicle supplied on hire by the Contractor to the Company meet with an accident, while being utilized by the Company, no claim on account of damages to the vehicle and to the persons traveling in such vehicles including the employees of the contractor shall be maintainable on the company.

8.2 The Contractor shall cover this risk adequately by obtaining comprehensive insurance policies and the company shall not bear any expenses on this account

8.3 Should the vehicle supplied on hire by the contractor to the company by the contractor meet with an accident due to reasons attributable to the contractor or his employees and causes damages to the persons / property of the company, the contractor shall be liable to make good such losses in the manner as prescribed by the company.

9.0 OWNERSHIP PERMITS AND INSURANCE:

9.1 Vehicle Deployed in the company on hire should possess valid and current permits / licences including Commercial Taxes as may be required by the respective RTOs for the whole duration of the contract.

9.2 . No amount is payable by the company for obtaining such permits / licences.

9.3. To keep proper licence and documents for the vehicle is the prime responsibility of contractor. In case of failure, NTPC can obtain such licence and documents at the cost of contractor and cost along with additional 20% overhead will be recovered from the bills of contractor.

9.4. A Photostat copy of such permits / licences shall be submitted to the authorized officer of the company before commencement of work.

9.5. The contractor shall ensure that the vehicles supplied on hire to the Company are comprehensively insured and maintained current and valid during the total period of contract.

9.6. The cost of such insurance shall not be borne by the Company.

9.7. A Photostat copy of such insurance policies of the vehicle hired by the company shall be made available to the company free of cost by the contractor before commencement of work. If any renewals or amendments to those insurance policies are carried-out during the currency of the contract the contractor shall made available a copy of such change immediately to the company.

10.0 RETENTION CHARGES FOR OUTSTATION DUTIES:

10.1 For outstation duties to places like Bilaspur or Raipur, NTPC shall pay extra charges of Rs.100/- per trip beyond 100 kms. One way with or without night halt. In such cases no night halt charges shall be paid extra.

11.0 SPECIAL CONDITIONS:

11.1 Jeep driver must have a Mobile phone for communication. Wherever mobile communication fails, it is the responsibility of the driver to communicate with EIC/Authorized persons from nearest PCO booth. The expenditure incurred will not be reimbursed.

11.2 Any increase in taxes, Commercial taxes etc. during the currency of the contract period shall be born by the contractor. NTPC shall not pay any additional increase in taxes beyond the contract rate.

11.3 The persons (Driver) deployed by the contractor in the vehicles shall be paid wages by the contractor timely and in full as per the relevant status i.e. Driver - Skilled Category Such wages shall not be less than the minimum rates of wages notified by Central Government minimum wages rules and subsequent notification issued from time to time.

11.4 The trade of Driver comes under Skilled Category for which minimum wages as notified by The Government of India shall be paid.

11.5 The vehicle owner shall facilitate opening of savings bank account in the name of the Driver. Payment of wages shall be made to the driver through their SB Account only.

11.6 The driver should at least have 3 years experience.

11.7 The bio-data of Drivers including Voter ID Proof, Ration Card Proof or any of the valid Proof of identity is to be collected and the bio-data form is to be sent to the police for Verification in case the driver is not a local land oustee.

NOTE:-

1. The Bidder should quote their rate exclusive of Service Tax. Service tax, if applicable, shall be paid as extra by NTPC subject to submission of documentary evidence / invoice. No claim of Service Tax shall be entertain after the settlement of final bill.

2. All the Bidder should quote a single rate per day only, failing which, their bid shall be liable for rejection.

3. The tender will be evaluated on total value of this package (taking all the above items together). Successful bidder (i.e. the bidder to whom the work shall be awarded) shall have to agree to offer suitable rebate to maintain the lowest position to avoid the vitiation after completion of the work.

4. Tenderer should quote their rate in figure as well as in words. All cuttings/over writings should be attested by the tenderer failing which tender may be liable for rejection.

5. "If the rates/prices quoted by the successful bidder for item of the Bill of Quantities (wherever such rate/price have been called for in the bids) are found to be abnormally high or low in relation to the engineer's estimate of the cost of work to be performed under the contract, then NTPC may require the bidder to produce detailed rate/price analysis for item of the bill of quantities, to demonstrate the internal consistency of these rates/prices with the construction methods and sch. proposed. after evaluation of the rate/price analysis, NTPC may require that the amount of the performance security be increased at the expense of the successful bidder to a level sufficient to protect NTPC against financial loss in the event of default by the contractor under the contract, if award is placed on recommended bidder".

6. The final rate shall be on minimum competitive rate received. If required, there may be negotiation / discussion to arrive acceptable rate. All the parties have to agree for finalised rate by NTPC and rates shall remain firm.

SCOPE OF WORK & SPECIAL TERMS AND CONDITIONS

1.0 SCOPE / TYPE OF VEHICLE:

1.1The Contractor will be required to deploy vehicles with the following specifications:

2.0 PERIOD OF CONTRACT:

2.1 The Contract shall be valid for a period of two years i.e. 731 days from the date of commencement of work.

2.2 During the tenure of the contract if the company does not require the services of the vehicle, it can terminate the contract by giving one month’s notice.

2.3 Should performance of the contractor be found unsatisfactory, the contract shall be terminated without any notice forthwith.

2.4 However, the contract may be extended up to a period of one year at the same rates, terms & conditions, if the party agrees subject to recommendation of the Engineer-in-charge and validity of all required documents.

3.0 FORE-CLOSURE OF CONTRACT:

3.1 In the event of NTPC deciding that the services of the Jeeps are not required, NTPC may fore-close the contract by serving a one month's notice for the same by the Engineer-In-Charge to the Contractor. Upon such fore-closure, the Contractor shall be entitled for only the on account payment due to him for the work actually performed and as certified by the Engineer-In-Charge. No claim for loss of profit, etc… whatsoever shall be entertained subsequent to such fore-closure of the contract.

4.0 CANCELLATION OF CONTRACT:

4.1 If it is found that the performance of the Contractor is not satisfactory/non deployment of vehicle for more than 7 days and the Contractor does not take any remedial and corrective actions for improving the performance, even after serving of a notice of default, NTPC shall reserves the right to cancel the Contract by serving a 7 days final notice for the same. Upon such cancellation, the entire Earnest Money Deposit/ Security Deposit of the Contractor, lying with NTPC shall stand forfeited. NTPC shall also reserve the right to carry out the unfinished work at the risk and cost of the Contractor. Decision as taken by the Engineer-In-Charge as regards cancellation, etc. shall be final and binding on the Contractor and no further correspondences regards revocation of cancellation, waiver of forfeiture, etc., subsequent to the cancellation shall be entertained

5.0 SUPPLY AND PLACEMENT:

5.1 Vehicle will be engaged for 24 Hrs. daily and shall be supplied for all the days of contract period including Sundays and Holidays and to be reported to Engineer-in-charge.

5.2 Cost of diesel will be reimbursed at the prevailing rate, on the basis of 01(one) Liter per 12 Km run against production of documentary evidence like cash receipt/invoice in original from nearest outlet petrol

pump and certification by EIC. The cost of lubricants, oil shall be borne by the agency as per scope of work and condition of tender document/GCOC of NTPC.

5.3. Whenever vehicle hired is to be withdrawn for any reasons, the contractor should ensure prior replacement of such vehicle before withdrawal. Substitute vehicle shall be got approved from the user before withdrawing the earlier vehicle.

5.4 If the vehicle is not made available or un-authorized absent from duty, then a penalty of 50% of the hire charges for the period of absence will be levied and no payment for the period of absence will be made.

5.5. Contractor should obtain the Fitness Certificate from R.T.O. for the whole duration of the contract period and insurance to be obtained as per rules. He shall also pay all taxes as per the prevailing rules and regulations.

5.6. Drivers to be deployed by the contractor shall possess valid driving license.

5.7. Vehicle can be deployed at any site / area as per discretion of NTPC.

6.0 OVERTIME: Not applicable

7.0 INCOME TAX:

7.1 Income tax as per provision of Income tax Act from gross value of contract shall be deducted at source unless the contractor is exempted by Income Tax authorities.

7.2The Income tax rate prevailing at the beginning of the Contract will be taken as a reference rate. However, during the course of contract period, if there is any enhancement from reference rate, the differential amount will be reimbursed to the Contractor.

8.0 ACCIDENT:

8.1 Should the vehicle supplied on hire by the Contractor to the Company meet with an accident, while being utilized by the Company, no claim on account of damages to the vehicle and to the persons traveling in such vehicles including the employees of the contractor shall be maintainable on the company.

8.2 The Contractor shall cover this risk adequately by obtaining comprehensive insurance policies and the company shall not bear any expenses on this account

8.3 Should the vehicle supplied on hire by the contractor to the company by the contractor meet with an accident due to reasons attributable to the contractor or his employees and causes damages to the persons / property of the company, the contractor shall be liable to make good such losses in the manner as prescribed by the company.

9.0 OWNERSHIP PERMITS AND INSURANCE:

9.1 Vehicle Deployed in the company on hire should possess valid and current permits / licences including Commercial Taxes as may be required by the respective RTOs for the whole duration of the contract.

9.2. No amount is payable by the company for obtaining such permits / licences.

9.3. To keep proper licence and documents for the vehicle is the prime responsibility of contractor. In case of failure, NTPC can obtain such licence and documents at the cost of contractor and cost along with additional 20% overhead will be recovered from the bills of contractor.

9.4. A Photostat copy of such permits / licences shall be submitted to the authorized officer of the company before commencement of work.

9.5. The contractor shall ensure that the vehicles supplied on hire to the Company are comprehensively insured and maintained current and valid during the total period of contract.

9.6. The cost of such insurance shall not be borne by the Company.

9.7. A Photostat copy of such insurance policies of the vehicle hired by the company shall be made available to the company free of cost by the contractor before commencement of work. If any renewals or

Amendments to those insurance policies are carried-out during the currency of the contract the contractor shall made available a copy of such change immediately to the company.

10.0 RETENTION CHARGES FOR OUTSTATION DUTIES:

11.0 SPECIAL CONDITIONS:

11.1 Jeep driver must have a Mobile phone for communication. Wherever mobile communication fails, it is the responsibility of the driver to communicate with EIC/Authorized persons from nearest PCO booth. The expenditure incurred will not be reimbursed.

11.2 Any increase in taxes, Commercial taxes etc. during the currency of the contract period shall be born by the contractor. NTPC shall not pay any additional increase in taxes beyond the contract rate.

11.3 The persons (Driver) deployed by the contractor in the vehicles shall be paid wages by the contractor timely and in full as per the relevant status i.e. Driver - Skilled Category Such wages shall not be less than the minimum rates of wages notified by Central Government minimum wages rules and subsequent notification issued from time to time.

11.4 The trade of Driver comes under Skilled Category for which minimum wages as notified by The Government of India shall be paid.
