NTPC, Badarpur invites expression of interest from interested units manufacturing fly ash orclay -fly ash bricks, blocks and tiles in the prescribed format for issue of Dry ESP Fly ash generated at NTPC, Badarpur on free of charge basis from dry fly ash silos of Badarpur Thermal Power Station, New Delhi for a period of Two year or till such time Dry ESP Fly ash is available from these units, whichever is earlier.

Issue of Dry ESP Fly Ash on free of charge basis by NTPC, Badarpur shall be only to eligible units submitting details in the prescribed format on or before25/04/2015 in the office of AGM (AM), BTPS, New Delhi-110044.

Annexure-I

Application Form for Issue of Dry ESP Fly Ash on Free of charge basis from NTPC Badarpur to units Manufacturing fly Ash or clay- fly ash bricks, blocks and tiles.

Note:-

The available Dry ESP Fly Ash for free issue by NTPC, Badarpur shall be allotted only to eligible units (As

per GOI Notification vide SO.2804 (E) dated 03.11.2009) on pro-rata basis of monthly schedules (based on

Monthly request submitted by manufactures).

Monthly allotment by NTPC, Badarpur to any prospective manufacturer shall be subject to:

i) Availability of Dry ESP Fly Ash at the silos of NTPC, Badarpur.

ii) Advance submission of quantity of Dry ESP Fly Ash required from NTPC, Badarpur in next month

by 7th of the running month.

Qualifying requirements:

The dry fly ash issued “free of cost” should be used only for manufacture of fly ash bricks, clay-fly ash bricks, blocks and tiles and no dry fly ash should be issued to defaulter units. The fly ash brick manufacturer, to whom fly ash has been proposed to be issued on free of cost basis should submit the following documents for verification to Ash Utilization Group of Station before issuance of fly ash to them :

· SSI registration (Part II)/ License to Work as a Factory.

· VAT Registration with Commercial Tax Dept if applicable.

· Excise Duty Registration as applicable/ documentary evidence for non applicability.

· Pollution Clearance Certificate/ consent order from SPCB

· Latest Power Bills/ DG set energy meter Reading (Quarterly basis).

· Ash End Use Certificate (on quarterly basis. Format enclosed)

In case, the dry fly ash issued on “free of cost basis” to the manufacturer of ash bricks/blocks/tiles have not been utilised for these purposes but sold in the market, permission given for lifting of fly ash to such agency should be terminated and such agency shall be banned for doing business dealing with NTPC .

Annexure - II

TERMS AND CONDITINS RELATED TO LIFTING OF DRY FLY ASH FROM NTPC-Badarpur

1. We agree that the permission to lift Dry ESP Fly Ash is purely tentative and can be revoked by NTPC-Badarpur at any time without any prior intimation/ notice depending upon NTPC policies and Government rules and regulations made in this regard from time to time. We also understand that no assurance/ assurances are made on behalf of NTPC for the quantities requested or for the quality of fly ash & fly ash is only being issued subject to availability on “as is where is basis” from silos of NTPC Badarpur.

2. We shall make our own arrangements for transporting fly ash through a duly authorized transporter with signature attested. Alternately, we shall intimate the vehicle numbers which will carry fly ash to our works from NTPC in order to obtain security permission and accordingly authorize our representative with signature attested for collecting gate passes.

3. We agree to obtain gate passes during general shift office hours through our representative.

4. We shall deposit a refundable interest free security amount of Rs. 20,000/- (Rupees Twenty thousand only) in the form of Demand Draft in favour of NTPC Ltd. Payable at Badarpur towards rectification/cost of damages if occurred to NTPC property.

5. We agree that NTPC is at liberty to suspend and stop issue of fly ash at its own discretion without assigning any reasons.

6. We agree that permission for lifting of fly ash is being given to us for a bonafide purpose mentioned in our application only and any misuse of fly ash is strictly prohibited.

7. We agree that NTPC shall not be held responsible in any way, either legally or financially for any accidents causes to the laborers, transporters, drivers & cleaners being engaged by us & also caused to any third party, either within or outside the NTPC factory premises. In case of happening of any such events, no liability, whatever, shall be fastened on NTPC and we undertake to indemnify and keep indemnify NTPC against all such claims that may be brought against NTPC for such incidents.

8. In the event of occurrence of such incident as mentioned at Sl. No. 7 above, we undertake to pay the statutory compensations and ensure to fulfill other related obligations as per relevant Laws.

9. We undertake to abide by the security rules and regulations of NTPC and further undertake to abide by the rules laid by NTPC towards Entry/ Exit systems for our vehicles/Personnel

10. We agree that we shall load Dry ESP Fly Ash in Tanker/bulker/bags.

11. We undertake to ensure the safety and security of men and material of NTPC Badarpur and further undertake to indemnify NTPC towards any loss or damage caused in this regard.

12. We agree that in case of bulker deployed for lifting of fly ash a cleaner/ helper shall invariably accompany the driver from factory gate to the loading point and return for helping in positioning of the vehicle. In case of absence of cleaner/helper in this regard NTPC shall be at liberty to disallow entry of the said bulker into its factory premises. We undertake to submit personal verification documents as required by NTPC for permission of entry into the factory premises.

13. We undertake that all the vehicles provided by our transporters for lifting the Fly ash from NTPC Badarpur strictly fulfills all the requirements laid down under the Motor Vehicles Act and Factories Act, etc.

14. We shall strictly ensure that our vehicles shall refrain from over speeding within the NTPC Factory premises and shall adhere to the speed limit of 15 Kmph. We undertake to park the Vehicles only at the designated parking places and not at any other places. We shall adhere to blow of reverse horn while reversing the vehicle. We agree that our laborers, transporters, drivers & cleaners shall not resort to washing of vehicles/ clothes in the Factory premises and shall not use the factory premises for bathing or sleeping.

15. We undertake that our laborers, transporters, drivers & cleaners or our personnel shall only be present at the fly ash issue/loading area and shall not stay/ loiter unauthorized in any other locations in the factory area, In case any of our persons are found in unauthorized locations except the designated places, NTPC may take suitable action as deemed fit and proper.

16. We undertake to submit monthly receipts of fly ash of previous month by 7^th of every succeeding month.

UNDERTAKING

This Deed of undertaking is made on this ………. day of ……………(month) ……….(year) by ………………………… a company registered under the Companies Act, 1956 / Registered partnership Firm / Sole Proprietor (whichever applicable ), represented by its ……………………………………………………. authorized signatory having its registered Office at ………………………………. (hereinafter called “the manufacturers”, which expressions shall unless repugnant to the context or meaning thereof include its successors and assigns), in favour of M/s. NTPC Limited, a Company incorporated under the Companies Act, 1956, having its registered office at Core – 7, Scope Complex, Lodhi Road, Institutional Area, New Delhi – 110003 having one of its project at Badarpur (hereinafter called “NTPC Badarpur.” which expression shall unless repugnant to the context or meaning thereof include its successors and assigns).

(1)Whereas, as per notification of Ministry of Environment and Forests vide Gazette of India vide SO.2804 (E) dated 03.11.2009 (amendment of original notification dated 14.09.1999) “ All coal or lignite based thermal power stations would be free to sell fly ash to the user agencies subject to the following conditions, namely-

1. the pond ash should be made available ‘free of any charge on as is where is basis’ to manufacturers of bricks, blocks or tiles including clay fly ash product manufacturing units (s) farmers, the Central and the State Road Construction Agencies, Public Works Department, and to agencies engaged in backfilling or stowing of mines.

2. At least 20% of dry ESP fly ash shall be made available free of charge to units manufacturing fly ash or clay-fly ash bricks, blocks and tiles on a priority basis over other users and if the demand from such agencies falls short of 20% of quantity, the balance quantity can be sold or disposed of by the power stations as may be possible.

Provided that the fly ash obtained from the thermal power station should be utilized only for the purpose for which it was obtained from the thermal power station or plant failing which no fly ash shall be made available to the defaulting users”.

(2)Whereas, we are the manufacturer of brick/ block/ Tiles and have submitted our application dt ……………… to the NTPC for getting our selves registered for issue of Dry Fly Ash for using the same in our Brick/Block/Tiles manufacturing process.

(3)Whereas, NTPC Badarpur has accepted our request and have consented for issue of the Dry ESP Fly Ash from its silo.

(4)Whereas, in terms of the MoEF Gazette Notification, NTPC requested the manufacturer to submit an undertaking for not misusing the fly ash issued by NTPC.

NOW, THEREFORE, THIS UNDERTAKING WITNESSETH AS FOLLOWS:

1. That we hereby undertake that the Dry Fly Ash drawn from NTPC Badarpur. From time to time shall exclusively be used for the purpose of manufacturing of Bricks/ Blocks/ Tiles as mentioned in our application dated ……………… and shall not be diverted / used to any other purpose or to anybody else.

2. That in case of any report of misuse of Fly Ash drawn from NTPC Badarpur or whenever it comes to the knowledge of NTPC Badarpur Authorities, we undertake unconditionally that NTPC Badarpur can stop the issue of Fly Ash to our Company/ Firm.

3. That we shall undertake to make advance payments to NTPC Badarpur towards excise duty and any other statutory duties/taxes levied on free fly ash from time to time if NTPC Badarpur decides to collect so.

4. That we shall undertake to adhere to the terms and conditions related to lifting of dry fly ash from NTPC-Badarpur as agreed by us, failing which NTPC Badarpur can stop the issue of Fly Ash to our company/firm.

5. That we hereby undertake to adhere to changes if any in the GOI policy/notification as & when implemented by NTPC Badarpur.

We also understand that NTPC Badarpur does not assure/guarantee any fixed quantity of fly ash to the manufacturers but the same shall only be given as per the availability at NTPC Badarpur. Hence we also undertake that we shall not make any claim whatsoever in this regards.

DECLARATION

With reference to our application ref.: ………….. dated…………… for free issue of fly ash to us from NTPC Ltd., Badarpur, We hereby make the following declaration. As our annual turnover is less than the threshold limits for applicability of excise duty, our unit is exempted from payment of Excise duty as per notification no. 8/2003 dt. 01.03.2003 and notification on 08/2007 dated 01.03.2007 of Central Excise. In case the information provided by us is found to be incorrect, we understand that NTPC Ltd. , Badarpur will stop further issue of ash to us apart from taking legal action
