NOTICE INVITING APPLICATIONS

 

FOR

 

ENLISTMENT OF CONTRACTORS  for

 

STARTER Ash dyke CIVIL WORKS PACKAGE for

 

ALL Thermal Power Projects / STATIONS OF NTPC

1.0     NTPC Limited invites online applications from eligible domestic Contractors for above mentioned enlistment. The brief scope of work is as follows :

 

The scheme for ash disposal envisages two storage lagoons and one common over flow lagoon (OFL) for ash disposal. Provision is also made for water escape structures for decantation of water from storage lagoons to OFL. Height of embankment depends as per the topography of the proposed ash dyke area. Construction of two well type water escape structure with flexible opening is also envisaged for decanting water from storage lagoon to over flow lagoon. Construction of spillways is also envisaged for discharging excess rain water from storage lagoons to OFL and from OFL to the existing drainage.

 

The scope of work for Starter Ash Dyke package generally involves construction of Earthen embankment. Scope of work also involves construction of rock toe, toe drain and rip rap for downstream slope protection works of dyke embankment.

 

2.0      The Application for Enlistment will be available for examination and sale at the address given below as per following schedule:

3.0  Eligibility Criteria for Enlistment of Contractors for Starter Ash Dyke Civil Works Package for All Thermal Power Projects/Stations of NTPC.

 

Applicant who wishes to participate in the enlistment shall satisfactorily establish that it fulfills the Eligibility Criteria requirements stipulated hereunder:-

 

3.1.0       Applicant should have executed the following works within the preceding seven (07) years reckoned as on last date notified for receipt of application:

 

3.1.1       At least one earthen dam work or ash dyke work or reservoir embankment work of maximum height not less than 10.0 m, in one contract.

 

3.1.2       A cumulative progress of at least 8.4 Lacs Cu.M of earthwork in earthen dam work or ash dyke work or reservoir embankment or canal embankment work in one (01) year period, in one (01) or maximum two (02) concurrently running contracts.

 

Notes: The following notes (a to j) explain in detail the intention of various terms in eligibility criteria :

 

a)           Earth dams, ash dykes and reservoir embankments, which are designed as water retaining structures, shall be qualified for this work.  However, canal embankments, guide bunds along water courses shall be considered for qualification under clause 3.1.2 only. All other types of earth works such as road embankments, railway embankments, site leveling works etc. shall not be qualified.

 

b)          Sand / substitute filter media as filter either in chimney or in blanket or both; used in embankment shall be considered in earthwork quantity calculations.  Rock toe shall not be considered.

 

c)           For embankments/reservoir/dyke, the height and quantities shall be considered above formation level upto dyke top for eligibility criteria requirements purpose.

 

d)          Wherever the ash dykes and other embankments are constructed in different contracts, the height applicable to individual contract only and not the cumulative effect shall be considered for the purpose of determining compliance of clause 3.1.1.  For example, where the contract is for raising an embankment, only the raising portion shall be considered and not the earlier starter dyke.

 

e)           In clause 3.1.0 above, the word “executed” means the applicant should have achieved the criteria specified in the eligibility criteria within the preceding seven (07) year period even if the contract has been started earlier and /or is not completed / closed.

 

 

f)            In clause 3.1.1 above, applicant should have constructed entire 10.0 m height of embankment work specified in the eligibility criteria, within the preceding seven (07) year period, even if the contract has been started earlier and /or is not completed / closed.

 

g)          The “one (1) year period” means any continuous 12 months period. However, for two (02) concurrent works, the same 12 months period shall be considered.

 

h)          In case of works stipulated in 3.1.2 above, the word “earthwork” shall mean earth / ash.

 

i)            Reference works executed by the applicant, as a member of Joint Venture / Consortium can also be considered provided:

 

The allocation of scope of work between the partners of the joint venture / consortium is clearly defined in the executed JV agreement and the applicant’s scope of work and break-up of quantities executed by them as individual contribution in the Joint Venture / Consortium, duly authenticated by the client, meet the relevant provisions of eligibility criteria.

 

j)            Reference work executed by an applicant as a sub-contractor may also be considered provided the certificate issued by main contractor is duly certified by owner specifying the scope of work executed by the sub-contractor in support of eligibility criteria.

 

3.2.0       Financial criteria:

 

3.2.1       The average annual turnover of the applicant, in the preceding three (3) financial years as on the last date notified for  receipt  of application,  shall not be less than Rs. 38.30 Crores (Rupees Thrity Eight Crores thirty Lacs only).

 

3.2.2       The net worth of the Applicant as on the last day of the preceding financial year shall not be less than 25% of the paid-up share capital.

 

3.2.3       In case the applicant is not able to furnish its audited financial statements on stand-alone entity basis, the unaudited unconsolidated financial statements of the applicant can be considered acceptable provided the applicant furnishes the following further documents on substantiation of its qualification.

 

(i)             Copies of the unaudited unconsolidated financial statements of the applicant along with copies of the audited consolidated financial statements of the Holding Company.

 

(ii)            A Certificate from the CEO/CFO of the Holding Company, as per the format enclosed in the application documents, stating that the unaudited unconsolidated financial statements form part of the Consolidated Annual Report of the company.

 

3.2.4       In case where audited results for the last preceding financial year are not available, certification of financial statements from a practicing Chartered Accountant shall also be considered acceptable.

 

3.2.5       In case a applicant does not satisfy the financial criteria, stipulated at Cl. 3.2.1 and/or Cl. 3.2.2 above on its own, the holding company would be required to meet the stipulated turnover requirements at Cl. 3.2.1 above, provided that the net worth of such holding company as on the last day of the preceding financial year is at least equal to or more than the paid-up share capital of the holding company. In such an event, the applicant would be required to furnish along with its application, a Letter of Undertaking from the holding company, supported by Board Resolution, as per the format enclosed in the application documents, pledging unconditional and irrevocable financial support for the execution of the Contract by the applicant in case of award against project specific enquiry after the enlistment.

 

3.2.6       The unutilized line of credit for fund based and non-fund based limits with cash and bank balances including fixed deposits of the applicant as on a date not earlier than 15 days prior to the last date notified for receipt of application, duly certified by the Bankers shall not be less than Rs. 20.20 Crores (Rupees Twenty Crores and Twenty Lacs only). In case certificates from more than one bank are submitted, the certified unutilized limits shall be of the same date from all such banks.

 

3.2.7       Where another Company of the group acting as the Treasury Centre is responsible for Treasury Management of the applicant having combined credit/guarantee limit for the whole group, the applicant would be required to provide a Banker's certificate regarding the unutilized line of credit for fund based and non-fund based limits together with cash and bank balances including fixed deposits available to such Treasury Centre. Further, Treasury Centre shall certify that out of the aforesaid limits certified by the bankers, the Applicant shall have access to the line of credit of a level not less than the specified amount at Cl. 3.2.6 above. In proof of this, the applicant would be required to furnish along with its application, a Letter of Undertaking from the Treasury Centre, supported by a Resolution passed by the Board of Directors of the holding company, as per the format enclosed in the application documents, pledging unconditional and irrevocable financial support for the execution of the Contract by the applicant in case of award against project specific enquiry after the enlistment.

 

3.2.8       In case the Applicant's unutilized line of credit for fund based and non-fund based limits specified at Cl. 3.2.6 above is not sufficient, a comfort letter from one of the bankers specified in the application documents unequivocally stating that in case the applicant is enlisted, the Bank would enhance line of credit for fund based and non-fund based limits to a level not less than the specified amount at Cl. 3.2.6 above to the applicant or to the Treasury Management Centre as the case may be, shall be acceptable.

 

 

 

NOTES:

 

(i)                     Net worth means the sum total of the paid up share capital and free reserves.  Free reserves means all reserves credited out of the profits and share premium account but does not include reserves credited out of the revaluation of the assets, write back of depreciation provision and amalgamation. Further any debit balance of Profit and Loss account and miscellaneous expenses to the extent not adjusted or written off, if any, shall be reduced from reserves and surplus.

 

(ii)                    Other income shall not be considered for arriving at annual turnover.

 

(iii)                   The enlisted party shall have to re-confirm the criteria as stated at Clause 3.2.0 above at the time of submission of bid for a specific project through a “Certificate signed by CEO/CFO”, stating that the “Average Annual Turnover” of the Bidder in the immediately preceding three (03) financial years as on the date of bid opening for the project specific enquiry, the “Net Worth” as on the last day of the preceding financial year as on the date of bid opening for project specific enquiry and “Unutilized Line of Credit” for fund based and non fund based limits with cash and bank balances including fixed deposits as on a date not earlier than 15 days prior to the date of bid opening for project specific enquiry are not less than those specified under Clause 3.2.0 above.  Further, the unutilized line of credit shall be duly certified by the Banker. Alternatively, in case the Bidder’s unutilized line of credit is not sufficient, a comfort letter from one of the bankers specified in the documents, unequivocally stating that in case the Bidder is awarded the Contract against Project specific enquiry, the Bank would enhance line of credit for fund based and non-fund based limits to a level not less than the specified amount to the Bidder shall be acceptable.  These documents shall be separately submitted in a sealed envelope failing which the price bid shall not be opened.

 

3.3.0     Notwithstanding anything stated above, the Employer reserves the right to assess the capabilities and capacity of the Applicant / its collaborators/ associates / subsidiaries / group companies to perform the contract, should the circumstances warrant such assessment in the overall interest of the Employer.

 

4.0     Subsequent to enlistment, only the enlisted agencies will be allowed to submit the bids in respect of specific enquiry of Projects/Stations / Regional Headquarters / Corporate Centre for Starter Ash Dyke Civil Works packages till the time enlistment is valid.

 

5.0     NTPC reserves the right to reject any or all applications or cancel/withdraw the ‘Notice Inviting Applications’ without assigning any reasons whatsoever and in such case no Applicant or intending Applicant shall have any claim arising out of such action. NTPC shall also have the right to verify any information/document furnished by the Applicant/Agency/Company/Firm and inspect the works carried out by the Applicant/Agency/Company/Firm, if so required.

6.0     Applicants who respond within due date with application as mentioned above against this advertisement will only be considered for enlistment.

2.Before downloading /viewing the Enlistment document, Applicant has to pay requisite cost of Enlistment Document (non-refundable) either through payment gateway by clicking on “pay tender fee” after logging in to our SRM site or by sending a Crossed Account payee Demand Draft in favour of NTPC Limited payable at Mumbai to us directly, which should reach us at least three working days prior to last date of Sale of Enlistment Documents.

New Applicant having neither NTPC Vendor code nor E-tender User ID & Password

1. Duly filled Annexure-1 (format available in Guidelines to Bidders on the e-tender website given below) and PAN card scanned /photo copy (Self Attested) along with the detailed address should reach us at least three working days prior to last date of Sale of Enlistment Documents.

 

2.Before downloading /viewing the Enlistment document, Applicant has to pay requisite cost of Enlistment Document (non-refundable) either through payment gateway by clicking on “pay tender fee” after logging in to our SRM site or by sending a Crossed Account payee Demand Draft in favour of NTPC Limited payable at Mumbai to us directly, which should reach us at least three working days prior to last date of Sale of Enlistment Documents.

8.0     Issuance of Enlistment Documents to any Applicant shall not construe that such Applicant is considered to be qualified. The Applicant shall bear all costs incurred in the preparation and submission of the application and other actions implied. NTPC shall not be responsible or liable for such costs, regardless of the outcome of the enlistment process. 

                                                                                                         

Transfer of Enlistment Documents purchased by one intending Applicant to another is not permissible.
